{"data":{"id":"us-ky/krs-309.339","jurisdiction":"us-ky","citation":"KRS 309.339","heading":"Grounds  for refusal to issue or renew  a license, suspension  or","body":"revocation of a license, administrative reprimand, probation, or fine --\nHearing.\n(1) The  board may deny or refuse to renew a license, may suspend or revoke a\nlicense, may issue an administrative reprimand, or may impose probationary\nconditions or fines not to exceed five hundred dollars ($500) when the licensee\nhas  engaged in unprofessional conduct that has endangered or is likely to\nendanger the health, welfare, or safety of the public. Unprofessional conduct\nshall include the following:\n(a) Obtaining or attempting to obtain a license by fraud, misrepresentation,\nconcealment of material facts, or making a false statement to the board;\n(b) Being convicted of a felony in any court if any act for which the licensee\nor applicant for license was convicted is determined by the board to have\na direct bearing on whether the person is trustworthy to serve the public\nas a licensed diabetes educator, if in accordance with KRS Chapter 335B.\n\"Conviction,\" as used in this paragraph, shall include a finding or verdict\nof guilty, an admission of guilt, or a plea of nolo contendere in a court of\nlaw;\n(c) Violating any lawful order or administrative regulation promulgated by the\nboard;\n(d) Violating any provision of KRS  309.325 to 309.339 or administrative\nregulation promulgated by the board;\n(e) Evidence of gross negligence or gross incompetence in the practice of\ndiabetes education; and\n(f) Violating the standards of practice or the code of ethics as promulgated\nby administrative regulations.\n(2) All administrative hearings for the disciplinary action against a license or\ncertificate holder shall be conducted in accordance with KRS Chapter 13B.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46800","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"d4b9640ed01d1402a34003108a116ff97eb86d212f1fbbb4c246858be4e7964f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.337","next":"us-ky/krs-309.350"},"notice":"GroundRules: Original legal text.
