{"data":{"id":"us-ky/krs-309.352","jurisdiction":"us-ky","citation":"KRS 309.352","heading":"Scope of KRS 309.350 to 309.364.","body":"KRS 309.350 to 309.364 shall not preclude:\n(1) Persons duly licensed, registered, or certified as massage therapists in another state\nor territory, the District of Columbia, or a foreign country teaching a course related\nto massage therapy or consulting wi th a person licensed under KRS 309.350 to\n309.364;\n(2) Students enrolled in a program recognized by the board and completing a clinical\nrequirement for graduation while under the supervision of a board-licensed massage\ntherapist or other licensed health -care professional as defined by the board in\nadministrative regulation;\n(3) A person administering a massage to members of the person's immediate family;\n(4) Persons who restrict manipulation of the soft tissues of the human body to the\nhands, feet, or ears, and do not hold themselves out to be massage therapists;\n(5) Persons who use procedures within the scope of practice of their profession, which\nhas established standards and ethics, provided that their services use touch, words,\nand directed movement to d eepen awareness of existing patterns of movement in\nthe body as well as to suggest new possibilities of movement while engaged, but\nwho are not designated or implied to administer massage or to be massage\ntherapists. These practices include, but are not li mited to, the Feldenkrais Method\nand the Trager Approach;\n(6) Persons engaged within the scope of practice of a profession with established\nstandards and ethics in which touch is limited to what is essential for palpation and\naffecting of the human energy system, provided that their services are not\ndesignated or implied to be massage or massage therapy. These practices include\nbut are not limited to polarity therapy;\n(7) Persons duly licensed, certified, or registered in another state or territory, the\nDistrict of Columbia, or a foreign country when incidentally in this state to provide\nservice as a part of an emergency response team working in conjunction with\ndisaster relief officials or as part of a charity event, athletic event, or artistic\nperformance;\n(8) Students participating in massage therapy classes or continuing education while in\nthe classroom or practicing on a classmate and not holding themselves out as\nmassage therapists or accepting compensation for the practice; or\n(9) Practitioners of the following occupations and professions regulated by state law\nwhile engaging in the practices for which they are duly licensed and while not\nholding themselves out to be massage therapists:\n(a) Physicians, osteopaths, podiatrists, and athletic trainers regu lated under KRS\nChapter 311;\n(b) Chiropractors regulated under KRS Chapter 312;\n(c) Registered nurses and practical nurses regulated under KRS Chapter 314;\n(d) Barbers, cosmetologists, and estheticians regulated under KRS Chapters 317\nand 317A, respectively;\n(e) Occupational therapists regulated under KRS Chapter 319A; and\n(f) Physical therapists regulated under KRS Chapter 327.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47224","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"8ba573f592248d8ec26d7afad2f1895868dd8c71d4fa76d78d497cbaee2dee1f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.351","next":"us-ky/krs-309.353"},"notice":"GroundRules: Original legal text.
