{"data":{"id":"us-ky/krs-309.357","jurisdiction":"us-ky","citation":"KRS 309.357","heading":"Establishment of schedule of fees for issuance, active and inactive renewal,","body":"and restoration of licenses and certificates -- Continuing professional\neducation.\n(1) (a) The board shall promulgate administrative regulations establishing a\nreasonable schedule of fees and charges for the issuance and restoration of\nlicenses and certificates, and for the renewal of licenses and certificates issued\nunder KRS 309.350 to 309.364.\n(b) Former licensees with an expired license may have their licenses rei nstated\nupon payment of the renewal fee plus a reinstatement fee as promulgated by\nadministrative regulations of the board. If the reinstatement application is\nmade within five (5) years from the date of termination, applicants shall not be\nrequired to submit to any examination as a condition for reinstatement.\n(c) A revoked license may not be reinstated or renewed. For a license that is\nreinstated, the licensee shall pay the reinstatement fee and the renewal fee as\nestablished by the board through administrative regulations.\n(d) A former licensee who fails to reinstate a license within five (5) years after\ntermination may not have it renewed, restored, or reinstated. A person may\napply for and obtain a new license by meeting the current requirements for\nlicensure.\n(e) The board may require that a person applying for a renewal or reinstatement of\nlicensure show evidence of completion of continuing professional education\nas prescribed by the board in administrative regulations.\n(f) If the board determines that  the applicant practiced on an expired license, the\nboard may require one (1) continuing education credit per month of\nexpiration, at the discretion of the board.\n(2) Any licensed massage therapist who does not desire to meet the qualifications for\nactive license renewal shall, upon application and payment of an inactive renewal\nfee, be issued an inactive license. The license shall not entitle the license holder to\nuse the term \"licensed massage therapist,\" or to engage in the practice of massage\ntherapy. T he inactive annual renewal fee shall be promulgated by the board in\nadministrative regulation.\n(3) To regain active status, the licensee shall, upon the submission of an application,\nshow completion of one (1) hour of continuing professional education for every six\n(6) months the license has been in an inactive state, not to exceed five (5) years.\nWaivers or extensions of continuing education may be approved at the discretion of\nthe board.
