{"data":{"id":"us-ky/krs-309.362","jurisdiction":"us-ky","citation":"KRS 309.362","heading":"Grounds for refusal to issue or renew a license, suspension or revocation of","body":"a license, administrative reprimand, or probation.\n(1) The board may deny or refuse to renew a license, may suspend or revoke a license,\nmay issue an administrat ive reprimand, or may impose probationary conditions or\nfines not to exceed one thousand dollars ($1,000) per violation when the licensee\nhas engaged in unprofessional conduct that has endangered or is likely to endanger\nthe health, welfare, or safety of the public. Unprofessional conduct shall include the\nfollowing:\n(a) Obtaining or attempting to obtain a license by fraud, misrepresentation,\nconcealment of material facts, or making a false statement to the board;\n(b) Being convicted of a felony in any cour t if the act or acts for which the\nlicensee or applicant for license was convicted are determined by the board to\nhave a direct bearing on whether the person is trustworthy to serve the public\nas a licensed massage therapist, if in accordance with KRS Chap ter 335B.\n\"Conviction,\" as used in this paragraph, includes a finding or verdict of guilty,\nan admission of guilt, or a plea of nolo contendere in a court of law;\n(c) Violating any lawful order or administrative regulation promulgated by the\nboard;\n(d) Violating any provision of this chapter or administrative regulations\npromulgated under this chapter;\n(e) Having sexual contact as defined in KRS 510.010 with a client or having\nengaged or attempted to engage in lewd or immoral conduct with any client or\npatient;\n(f) Engaging in fraud or material deception in the delivery of professional\nservices, including reimbursement or advertising services, in a false or\nmisleading manner;\n(g) Evidence of gross negligence or gross incompetence in the practice of\nmassage therapy;\n(h) Violating the standards of practice or the code of ethics as promulgated by\nadministrative regulations;\n(i) Violating KRS 304.39-215; or\n(j) Engaging in conduct that is subject to the penalties under KRS 304.99 -060(4)\nor (5).\n(2) The board may, at its discretion, deny, refuse to renew, suspend or revoke a license,\nor impose probationary conditions following an administrative hearing pursuant to\nKRS Chapter 13B and in accordance with administrative regulations promulgated\nby the board.\n(3) The surrender of a license shall not deprive the board of jurisdiction to proceed with\ndisciplinary actions under KRS 309.350 to 309.364.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57425","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"4b799d7da7012754bda49bfaf880569719614d450514895b18115d0d170e16d2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.361","next":"us-ky/krs-309.363"},"notice":"GroundRules: Original legal text.
