{"data":{"id":"us-ky/krs-309.412","jurisdiction":"us-ky","citation":"KRS 309.412","heading":"License required to provide or hold oneself out as providing home medical","body":"equipment and services -- Exemptions.\n(1) No person shall provide home medical equipment and services, or use the title\n\"home medical equipment and services provider\" in conne ction with his or her\nprofession or business, without a license issued by the board.\n(2) Unless home medical equipment and services are provided through a separate legal\nentity, nothing in KRS 309.400 to 309.422 or any administrative regulations\npromulgated thereunder shall be construed as preventing or restricting the practices,\nservices, or activities of the following:\n(a) A person licensed or registered in this state under any other law who is\nengaging in the profession or occupation for which he or she is licensed or\nregistered;\n(b) Health care practitioners who lawfully prescribe or order home medical\nequipment and services, or who use home medical equipment and services to\ntreat their patients;\n(c) Home health agencies that do not engage in the provisi on of home medical\nequipment and services;\n(d) Hospitals that provide home medical equipment and services only as an\nintegral part of patient care;\n(e) Manufacturers and wholesale distributors of home medical equipment who do\nnot sell, lease, or rent home medical equipment directly to a patient;\n(f) Pharmacies that are engaged in the sale, lease, or rental of home medical\nequipment and services;\n(g) An employee of a person licensed under KRS 309.400 to 309.422;\n(h) Hospice programs that do not involve the s ale, lease, or rental of home\nmedical equipment and services;\n(i) Skilled nursing facilities that do not involve the sale, lease, or rental of home\nmedical equipment and services;\n(j) Government agencies, including fire districts which provide emergency\nmedical services; and\n(k) Notwithstanding subsection (1) of this section, an out -of-state provider whose\nprimary business is the manufacture, distribution, or both, of highly\nspecialized equipment who ships that equipment into this state if that\nequipment is not provided by a licensed Kentucky home medical equipment\nand services provider.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45239","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"a0fe3d705708118865550ea62a5ceda7a35e9c4e02d505367699d2c0f98d701d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.410","next":"us-ky/krs-309.414"},"notice":"GroundRules: Original legal text.
