{"data":{"id":"us-ky/krs-309.414","jurisdiction":"us-ky","citation":"KRS 309.414","heading":"Application for license -- Fee -- Record retention -- Administrative","body":"regulations -- Confidentiality.\n(1) A home medical equipment and services provider shall be licensed by the board\nprior to engaging in providing home medical equipment and services  in the\nCommonwealth. Each license application shall be accompanied by a reasonable fee\nprescribed by administrative regulation not to exceed three hundred fifty dollars\n($350) initially every two (2) years or increase more than twenty -five dollars ($25)\nper biennium up to a maximum of four hundred dollars ($400). Upon receipt of an\napplication for a license to operate as a home medical equipment and services\nprovider, the board shall issue a license if the provider meets the standards and\nrequirements of t his section or KRS 309.420 and the administrative regulations of\nthe board.\n(2) Home medical equipment and services providers shall be required to maintain\nadequate records of all home medical equipment and services provided as\nestablished by administrativ e regulation by the board. Records shall be made\navailable to agents of the board for inspection at reasonable times. The board may\nrequire by administrative regulation that home medical equipment and services\nproviders periodically report to the board all  home medical equipment and services\nprovided.\n(3) Failure to report to the board or willful submission of inaccurate information shall\nbe grounds for disciplinary action under KRS 309.418.\n(4) The board shall promulgate an administrative regulation pursua nt to KRS Chapter\n13A to specify the criteria for licensure.\n(5) Pursuant to KRS 61.878, information provided by an applicant under this section\nand any related administrative regulation shall not be disclosed to any person or\nentity other than the board.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45243","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"15bc267c988bc086762d24d77cc17736b5e71e010baa8ae02bcea1d1b22ea728","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.412","next":"us-ky/krs-309.416"},"notice":"GroundRules: Original legal text.
