{"data":{"id":"us-ky/krs-309.420","jurisdiction":"us-ky","citation":"KRS 309.420","heading":"Reciprocity with bordering states.","body":"(1) (a) The board may grant a license on the basis of reciprocity to a home medical\nequipment and services provider located in one (1) of Kentucky's seven (7)\ncontiguous bordering states that licenses home medical equipment and\nservices providers if:\n1. The out -of-state provider physically located in one (1) of Kentucky's\nseven (7) contiguous bordering states possesses a valid license from a\njurisdiction that grants the same privileges to persons licensed by the\nCommonwealth as the Commonwealth grants to persons li censed by the\nother jurisdiction;\n2. The requirements for licensure in the contiguous bordering state,\nincluding but not limited to a requirement for a physical location in the\nstate as a condition of issuing or renewing a license, are substantially\nsimilar to the requirements under KRS 309.400 to 309.422; and\n3. The out -of-state provider seeking licensure states that he or she has\nstudied, is familiar with, and shall abide by KRS 309.400 to 309.422 and\nthe administrative regulations promulgated thereunder.\n(b) 1. Notwithstanding subsection (2) of this section, the board may grant a\nlicense on the basis of reciprocity to a home medical equipment and\nservices provider physically located in one (1) of Kentucky's seven (7)\ncontiguous bordering states that does not license home medical\nequipment and services providers if the out -of-state provider seeking to\noperate in Kentucky states by affidavit that he or she has studied, is\nfamiliar with, and shall abide by KRS 309.400 to 309.422 and the\nadministrative regulations promulgated thereunder; and\n2. The contiguous bordering state grants the same privileges to persons\nlicensed in the Commonwealth as the Commonwealth grants to\nproviders from the state described in subparagraph 1. of this paragraph.\n(2) If the requirem ents for licensure under KRS 309.400 to 309.422 and the\nadministrative regulations promulgated thereunder are more restrictive than the\nstandards of a contiguous jurisdiction, then the out -of-state provider shall comply\nwith the additional requirements of KRS 309.400 to 309.422 to obtain a reciprocal\nlicense.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45247","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"adeec3ceb4055dba4a1a3e9f79480c19415090ee19a78c40bb209c037d52de1a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.418","next":"us-ky/krs-309.422"},"notice":"GroundRules: Original legal text.
