{"data":{"id":"us-ky/krs-309.434","jurisdiction":"us-ky","citation":"KRS 309.434","heading":"Powers and responsibilities of Board of Radon Safety.","body":"The board shall:\n(1) Promote the control of radon in the Commonwealth of Kentucky;\n(2) Develop and conduct programs for evaluation and control of activities related to\nradon, including laboratory analyses, measurement, and mitigation;\n(3) Promulgate admini strative regulations in accordance with KRS Chapter 13A to\nadminister, coordinate, and enforce KRS 309.430 to 309.454;\n(4) Issue a registration certificate to certified persons or business entities registered by\nthe board;\n(5) Maintain a public list of all  certified persons or business entities registered by the\nboard;\n(6) Design and administer, or participate in the design and administration of,\neducational and research programs to ensure the citizens of the Commonwealth are\ninformed about the health risks associated with radon;\n(7) Enter into agreements with any federal or state agency, political subdivision,\npostsecondary education institution, nonprofit organization, or other person or entity\nto assist with and administer grants received by the board, in cluding but not limited\nto the Environmental Protection Agency State Indoor Radon Grant (SIRG) program;\n(8) Prepare an annual budget for the use of moneys received by the board from the\ncollection of fees and fines, receipt of grants, and all other radon-related activities;\n(9) Establish and maintain office space and personnel, as necessary, to administer,\ncoordinate, and enforce KRS 304.430 to 309.454;\n(10) Collect or receive all fees, fines, and other moneys owed pursuant to KRS 309.430\nto 309.454, and de posit all those moneys into the radon control fund established by\nKRS 309.454;\n(11) Issue subpoenas only through the board's attorney and only under the authority of\nthe board's general counsel;\n(12) Administer oaths, examine witnesses, investigate allegat ions of wrongdoing, and\nconduct administrative hearings in accordance with KRS Chapter 13B to enforce\nKRS 309.430 to 309.454; and\n(13) Record minutes of board meetings and proceedings which shall be documented and\nmade available for public inspection.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52680","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"a6d727771d1a65b07824cc8a063da3f542ebc12636a6c64cdcae7b3cf8df2f3c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.432","next":"us-ky/krs-309.436"},"notice":"GroundRules: Original legal text.
