No person or business entity shall\nadvertise or claim to be a \"certified measurement contractor,\" \"certified mitigation\ncontractor,\" or \"certified radon laborato ry,\" unless certified pursuant to KRS 309.430 to\n309.454. Certification requirements under KRS 309.430 to 309.454 shall apply to a radon\nmeasurement contractor, radon mitigation contractor, or radon laboratory, but shall not\napply to:\n(1) A person performi ng measurement or mitigation on a single -family residential\nbuilding that he or she owns and occupies;\n(2) A person performing measurement on a residential or commercial building that he\nor she owns;\n(3) A person performing measurement who assists, and is under the general supervision\nof, a measurement contractor;\n(4) A person performing mitigation who assists, and is under the direct supervision of,\na mitigation contractor;\n(5) An agent of the federal, state, or local government agency acting within an off icial\ncapacity;\n(6) A person performing measurement or mitigation as part of a scientific research\nproject approved by the cabinet;\n(7) A retail store or any other organization that sells or distributes radon measurement\ndevices and is not engaged in a rel ationship with the client for other services, such\nas home inspection or real estate brokerage, and that does not conduct\nmeasurement, mitigation, or laboratory analysis;\n(8) A person performing measurement or mitigation as part of radon training approved\nby a proficiency program; or\n(9) A building contractor installing vent pipes during the construction of a commercial\nbuilding or home.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52682","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"8556b156b3ac1b9697b85911336de600abd6dd93086b0dab602ef80ba817c54e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.434","next":"us-ky/krs-309.438"},"notice":"GroundRules: Original legal text.
