{"data":{"id":"us-ky/krs-309.438","jurisdiction":"us-ky","citation":"KRS 309.438","heading":"Registration as radon measurement contractor -- Renewal of registration","body":"certificate -- Duties of measurement contractor.\n(1) The board shall issue a radon measurement contractor registration certificate to any\nperson certified for measurement who:\n(a) Completes a registration process prescribed by the board through\npromulgation of an administrative regulation;\n(b) Presents proof of compliance with a board-approved proficiency program; and\n(c) Furnishes evidence of a general liability insuran ce policy that satisfies the\nrequirements of KRS 309.442.\n(2) The board shall renew the radon measurement contractor registration certificate of\nany person who:\n(a) Completes a registration renewal process and pays a fee prescribed by the\nboard through promulgation of an administrative regulation;\n(b) Presents proof of compliance with a board-approved proficiency program; and\n(c) Furnishes evidence of a general liability insurance policy that satisfies the\nrequirements of KRS 309.442;\n(3) A measurement contractor shall:\n(a) Maintain certification with a board-approved proficiency program;\n(b) Ensure all measurements are conducted in accordance with the applicable\nstandard operating procedures;\n(c) Maintain a quality control program plan in accordance with th e standard\noperating procedures for measurement quality assurance and control;\n(d) Ensure all measurements are conducted under the general supervision of a\nmeasurement contractor;\n(e) Use or sell only measurement devices approved by the proficiency program\nthat certifies the person; and\n(f) Ensure all laboratory analysis is procured through a radon laboratory.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52684","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"705299fbf5e9b8bd22c0c91b2368ceb762b4fbd993d9f59674fae997fb4ef46e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.436","next":"us-ky/krs-309.440"},"notice":"GroundRules: Original legal text.
