{"data":{"id":"us-ky/krs-309.440","jurisdiction":"us-ky","citation":"KRS 309.440","heading":"Registration as mitigation contractor -- Renewal of registration certificate","body":"-- Duties of mitigation contractor.\n(1) The board shall issue a mitigation contractor registration certificate to any person\ncertified for mitigation who:\n(a) Completes a registration process prescribed by the board through\npromulgation of an administrative regulation;\n(b) Presents proof of compliance with a board-approved proficiency program; and\n(c) Furnishes evidence of a general liability insurance policy that s atisfies the\nrequirements of KRS 309.442.\n(2) The board shall renew the mitigation contractor registration certificate of any person\nwho:\n(a) Completes a registration renewal process and pays a fee prescribed by the\nboard through promulgation of an administrative regulation;\n(b) Presents proof of compliance with a board-approved proficiency program; and\n(c) Furnishes evidence of a general liability insurance policy that satisfies the\nrequirements of KRS 309.442.\n(3) A mitigation contractor shall:\n(a) Maintain certification with a board-approved proficiency program;\n(b) Ensure all mitigations are conducted in accordance with the applicable\nmitigation standard operating procedures;\n(c) Maintain a quality control program plan in accordance with the applicable\nstandard operating procedures for mitigation quality assurance and control;\n(d) Ensure all mitigation is conducted under the direct supervision of a mitigation\ncontractor;\n(e) Ensure all post -mitigation measurement is conducted by a measurement\ncontractor; and\n(f) Ensure all radon mitigation systems repaired or altered on or after January 1,\n2013, meet the applicable mitigation standard operating procedures.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52686","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"4fad20e26d994365827ceae6d97565aafebd7df341613708f5d98731264855b2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.438","next":"us-ky/krs-309.442"},"notice":"GroundRules: Original legal text.
