{"data":{"id":"us-ky/krs-309.448","jurisdiction":"us-ky","citation":"KRS 309.448","heading":"Sanctions for misconduct -- Board's powers -- Appeals.","body":"(1) Subject to an administrative hearing conducted in accordance with KRS Chapter\n13B, the board may revoke, suspend, or restrict the registration of a registrant,\nrefuse to issue or renew registration, reprimand, censure, place on probation, or\nimpose a fine not to exceed one thousand dollars ($1,000) per occurrence on a\ncertified person or business entity who:\n(a) Has been convicted of a felony under the laws of the Commonwealth of any\ncrime that involves theft or dishonesty, or is a sex crime as defined by K RS\n17.500;\n(b) Has had disciplinary action taken against a professional license, certification,\nregistration, or permit held by the person or business entity seeking\nregistration;\n(c) Engaged in fraud or deceit in obtaining certification or registration;\n(d) Attempts to transfer the authority granted by the registration to another person\nor business entity;\n(e) Disregards or violates the building codes, electrical codes, or related laws of\nthis Commonwealth or ordinances of any city, county, urban -county\ngovernment, consolidated local government, charter county government, or\nunified local government;\n(f) Aids or abets any person attempting to evade the provisions of KRS 309.430\nto 309.454 or the administrative regulations promulgated by the board;\n(g) Uses unfair or deceptive trade practices; or\n(h) Knowingly violates any of the provisions of KRS 309.430 to 309.454 or any\nadministrative regulation promulgated by the board.\n(2) If an application for registration or renewal of registration is denied, the perso n or\nbusiness entity seeking registration shall not conduct radon measurement,\nmitigation, or laboratory analysis within the Commonwealth of Kentucky.\n(3) Notwithstanding the existence or pursuit of any other civil or criminal remedy, the\nboard may institute proceedings in the Circuit Court of the county where the person\nresides or the business entity is located for an order enjoining the person or business\nentity from engaging or attempting to engage in activities that violate any provisions\nof KRS 309.430  to 309.454 or any administrative regulation promulgated by the\nboard.\n(4) Any final order of the board may be appealed to the Circuit Court of the county in\nwhich the person resides or the business entity is located after a written decision is\nrendered in accordance with KRS Chapter 13B.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52694","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"2ebf43632a42c10e4a071bbb7296e2da5a2dd8b679fc56815c14adb2cbe36095","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.446","next":"us-ky/krs-309.450"},"notice":"GroundRules: Original legal text.
