{"data":{"id":"us-ky/krs-309.450","jurisdiction":"us-ky","citation":"KRS 309.450","heading":"Board's powers to examine, inspect, and test -- Prohibition upon","body":"interfering with inspection.\n(1) The board may examine records of mitigation contractors, measurement contractors,\nand radon laboratories, including but not limited to conduct ing inspections of\nmitigation system installations and measurement locations in order to ensure that\nradon measurement, mitigation, and laboratory analysis are conducted in accordance\nwith the applicable standard operating procedures.\n(2) The board may tes t any equipment used for measurement, mitigation, or laboratory\nanalysis or photograph or sketch any portion of a site, building, or equipment\ninvolved in measurement, mitigation, or laboratory analysis.\n(3) No person shall use or continue to use, or permi t the use or continued use of, any\nradon mitigation system if an agent or inspector of the board finds that the radon\nmitigation system was not constructed, installed, or altered in accordance with the\napplicable mitigation standard operating procedures.\n(4) For purposes of enforcing KRS 309.430 to 309.454 or any administrative regulation\npromulgated by the board pertaining to radon measurement, mitigation, or\nlaboratory analysis, an agent or inspector of the board shall have the power to enter\nupon premises at all reasonable times to make an inspection, question all persons,\nand require the production of radon mitigation system plans, sketches, diagnostic\ninformation, and other evidence.\n(5) Agents and inspectors of the board shall be empowered to issue a s top order to any\nowner, agent, or occupant of real property requiring that the radon mitigation\nsystem thereon cease operation if that system has been found to be in violation of\nKRS 309.430 to 309.454 or any administrative regulation promulgated by the\nboard.\n(6) A person shall not interfere with an inspection conducted by an agent or inspector\nof the board.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52696","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"51e285c51cdaeb57100c5e2023239ee4fd7e69163bbbe6cbd5445beb9c9b9afd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.448","next":"us-ky/krs-309.452"},"notice":"GroundRules: Original legal text.
