{"data":{"id":"us-ky/krs-31.020","jurisdiction":"us-ky","citation":"KRS 31.020","heading":"Public advocate -- Qualifications -- Selection -- Term -- Salary -- Staff.","body":"(1) The Department of Public Advocacy shall consist of the public advocate, deputy\npublic advocate, general counsel, assistant public advocates as the public advocate\nshall deem necessary, and secretarial and other personnel as the public advocate\nshall deem necessary.\n(2) (a) The public advocate shall:\n1. Be appointed by the Governor from a list of three (3) attorneys\nsubmitted to him or her by the Public Advocacy Commission;\n2. Be an attorney licensed to practice law in Kentucky with at least five (5)\nyears of experience in the practice of law;\n3. Be excepted from the classified service;\n4. Be the chief administrator of the Department of Public Advocacy and an\nappointing authority as defined in KRS 18A.005; and\n5. Serve a term of four (4) years, which is renewable, unless removed by\nthe Governor.\n(b) The incumbent public advocate shall serve until a successor is nominated by\nthe commission and approved by the Governor.  The compensation of the\npublic advocate shall be set by KRS 64.640.\n(3) The deputy public advocate shall:\n(a) Be an attorney;\n(b) Be appointed by the public advocate; and\n(c) Serve at the pleasure of the public advocate.\n(4) The general counsel shall:\n(a) Be an attorney;\n(b) Be appointed by the public advocate;\n(c) Serve at the pleasure of the public advocate; and\n(d) Represent the interests of the department as directed by the public advocate.\n(5) The assistant public advocates shall:\n(a) Be attorneys;\n(b) Be appointed by the public advocate;\n(c) Be covered by the merit system; and\n(d) Not be subject to KRS 12.210.\n(6) Secretarial, clerical, and other personnel shall be appoint ed by the public advocate\nand shall be covered by the merit system.","path":["KRS Chapter 31"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57827","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:50Z","sha256":"33698e3b3426d8239901dd489c78867b9a476c2402346a5ef82c0b023fe9958b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-31.015","next":"us-ky/krs-31.025"},"notice":"GroundRules: Original legal text.
