{"data":{"id":"us-ky/krs-31.215","jurisdiction":"us-ky","citation":"KRS 31.215","heading":"Acceptance of fees by public advocacy attorneys prohibited -- Exceptions --","body":"Penalty.\n(1) (a) Except for attorneys appointed pursuant to KRS 31.120, 620.100, 625.041,\nand 625.080, an attorney providing representation under this chapter shall not\naccept any fees from any source other than the Department of Public\nAdvocacy for the representation of any needy person in any case or matter\nassigned to the attorney, or in any matter directly related to a case or matter\nassigned to the attorney.\n(b) The compensation for representation of a needy person under this chapter\nshall be limited to that which is provided by the department.\n(c) This subsection shall not prohibit an attorney who is not employed by the\ndepartment from accepting fees for th e representation of any person in any\ncase or matter unrelated to any case or matter that he or she has been assigned\nunder this chapter.\n(d) As used in this subsection, \"fees\" shall include cash, property, or other\npecuniary benefits of any kind.\n(2) This section shall not apply to unsolicited gifts of de minimis value that are given\nby or on behalf of a needy person to any attorney after the conclusion of a case or\nmatter as a token of appreciation for the work of the attorney.\n(3) Any attorney who violates this section shall be guilty of a Class D felony.","path":["KRS Chapter 31"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57832","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:51Z","sha256":"ef16beb61851e431282232ab17ddfb6b9ead5c95eb0af1ae11aa815a3774aeb0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-31.211","next":"us-ky/krs-31.219"},"notice":"GroundRules: Original legal text.
