{"data":{"id":"us-ky/krs-310.041","jurisdiction":"us-ky","citation":"KRS 310.041","heading":"Powers and duties of board.","body":"The board shall:\n(1) Promulgate administrative regulations in accordance with KRS Chapter 13A\nimplementing the provisions of KRS 310.005, 310.021, 310.031, 310.040, 310.041,\n310.042, 310.050, 310.070, and 310.990;\n(2) Issue initial licenses and certificates and license and certificate renewals;\n(3) Notify in writing any person determined by the board to be in violation of this\nchapter or the administrative regulations promulgated thereunder. The notification\nshall state that the person may request a hearing by the board within an amount of\ntime specified by the board. If a hearing is requested, the hearing shall be conducted\nin accordance with KRS Chapter 13B. If the person fails to request the hearing, or if\nthe board determines from the hearing that the person is in violation of this chapter\nor the administrative regulations promulgated thereunder, the board may apply to\nthe Circuit Court of the county in which the violation occurred for an injunction or\nother appropriate restraining order to prohibit the continued violation;\n(4) Publish and make available to the public, upon request and for a fee not to exceed\nthe actual cost of printing and mailing, the administrative regulations of the board\nand the requirements for licensure and certification;\n(5) Establish fees, subject to maximum limitations prescribed in this chapter, in\namounts sufficient to pay the expenses of the board directly attributable to the\nperformance of its duties pursuant to the provisions of this chapter;\n(6) Review and approve or reject the qualifications of  all applicants for licensure and\ncertification and issue all approved licenses and certificates;\n(7) Collect or receive all fees, fines, and moneys owed pursuant to the provisions of this\nchapter and to deposit all fees, fines, and moneys into the State T reasury to the\ncredit of a revolving fund for the use of the board. No part of this revolving fund\nshall revert to the general funds of this Commonwealth;\n(8) Deny, suspend, or revoke the license or certification of or to otherwise discipline or\nfine, by a dministrative penalty not to exceed five hundred dollars ($500), or\nreprimand a license or certificate holder found guilty of violating any provisions of\nthis chapter or the administrative regulations promulgated thereunder;\n(9) Promulgate administrative r egulations in accordance with KRS Chapter 13A to\nestablish conditions for granting a retired or inactive licensure status; and\n(10) Promulgate administrative regulations in accordance with KRS Chapter 13A to\nestablish procedures to permit a licensee or cer tificate holder to voluntarily\nrelinquish a license or certificate and conditions to reinstate a voluntarily\nrelinquished license or certificate.","path":["KRS Chapter 310"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30386","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"87cd080d8de1879ae9c59e26b852ee2cf34fb531592403648fac9a6ae33e83fa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-310.040","next":"us-ky/krs-310.042"},"notice":"GroundRules: Original legal text.
