{"data":{"id":"us-ky/krs-310.042","jurisdiction":"us-ky","citation":"KRS 310.042","heading":"Conduct  warranting denial, refusal to renew, or suspension  or","body":"revocation of license or certificate or disciplinary action -- Administrative\nhearing.\n(1) The  board may deny or refuse to renew a license or certificate, suspend or\nrevoke a license or certificate, or issue orders to cease and desist from certain\nconduct or to otherwise discipline an applicant, a licensee, a certificate holder,\nor a person found guilty of violating any provisions of this chapter, if that person\nhas:\n(a) Attempted  to or obtained licensure or certification by  fraud or\nmisrepresentation;\n(b) Engaged  in habitual intoxication or unprofessional conduct, including, but\nnot limited to, willful acts of negligence or a pattern of continued and\nrepeated malpractice, negligence, or incompetence in the course of\nprofessional practice;\n(c) Engaged  in habitual intoxication or personal misuse  of any  drug,\nnarcotics, or controlled substances so as to adversely affect his ability to\npractice;\n(d) Been  convicted of a crime as defined in KRS  335B.010, if in accordance\nwith KRS Chapter 335B;\n(e) Violated any lawful order or ruling of the board or any administrative\nregulation promulgated by the board; or\n(f) Violated any provisions of this chapter.\n(2) All administrative hearings for the disciplinary action against a license or\ncertificate holder shall be conducted in accordance with KRS Chapter 13B.","path":["KRS Chapter 310"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46803","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"457bb87c5e2ea142358e68479405dddc40c1dae89cb6095652ee20c4196c3c47","source_id":"us-ky","stale":false,"prev":"us-ky/krs-310.041","next":"us-ky/krs-310.050"},"notice":"GroundRules: Original legal text.
