{"data":{"id":"us-ky/krs-310.070","jurisdiction":"us-ky","citation":"KRS 310.070","heading":"Unlawful practice or use of title -- Exceptions.","body":"(1) It shall be unlawful for any person to engage in the practice of dietetics or\nnutrition, to act or to represent himself to be a dietitian or a nutritionist, or to\nuse  such  titles as  \"dietitian,\" \"nutritionist,\" \"licensed dietitian,\" \"certified\nnutritionist,\" or such letters as \"L.D.,\" \"C.N.,\" or any word, letters, or title\nindicating or implying that the person is a dietitian or nutritionist, unless that\nperson holds a license or certificate issued by the board.\n(2) Nothing in this chapter shall be construed to prevent or restrict:\n(a) A person licensed in this state from carrying out any therapy or practice\nfor which he is duly licensed, including but not limited to physicians,\nosteopaths, podiatrists, chiropractors, dentists, and nurses;\n(b) A  student enrolled in an approved academic program in dietetics, if the\npractice constitutes a part of a course of study under the supervision of a\nlicensed dietitian or certified nutritionist. The student shall be designated\nby title clearly indicating his status as a student or trainee;\n(c) A dietitian serving in the Armed Forces, the Public Health Service of the\nUnited States, or employed by the United States Department of Veterans\nAffairs from engaging in the practice of dietetics, if that practice is related\nto his service or employment;\n(d) Persons performing the activities and services of a nutrition educator in\nthe employment of a federal, state, county, or municipal agency or in an\nelementary  or  secondary  school  or  accredited degree  granting\neducational institution, if the activities and services are part of a salaried\nposition;\n(e) Federal, state, county, or municipal employees involved with nutrition\nrelated programs, including but not limited to, the cooperative extension\nservices, child nutrition programs, and Project Headstart from engaging in\nthe practice of dietetics or nutrition within the discharge of their official\nduties. Any person engaging in the practice of dietetics or nutrition outside\nthe scope of his official duties shall be licensed as provided in this\nchapter; or\n(f) Persons employed in a hospital or nursing home from performing dietary\nservices under the supervision of a licensed dietitian.\n(3) The  provisions of this chapter shall not apply to a person who owns a health\nfood store or who  manufactures, distributes, or sells health foods, dietary\nsupplements, or vitamins nor shall the provisions of this chapter be construed\nto affect any other person who provides nutritional or dietary advice or sells\nnutritional or dietary supplements if the person does not use the title dietitian,\nlicensed dietitian, or certified nutritionist.","path":["KRS Chapter 310"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45841","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"401f9bbe73262f615ab9bdacea8a08707ff00e6ed8ffdbf45de14c04c76df7ce","source_id":"us-ky","stale":false,"prev":"us-ky/krs-310.060","next":"us-ky/krs-310.080"},"notice":"GroundRules: Original legal text.
