{"data":{"id":"us-ky/krs-311.282","jurisdiction":"us-ky","citation":"KRS 311.282","heading":"Disclosure or failure to disclose confidential information under specified","body":"circumstances not to create civil or criminal liability.\n(1) A physician licensed pursuant to KRS Chapter 311 shall not be civilly or criminally\nliable for the disclosure of ot herwise confidential information under the following\ncircumstances:\n(a) If a patient of the physician has tested positive for human immunodeficiency\nvirus discloses to the physician the identity of a spouse or sexual partner with\nwhom the patient has cohabitated for more than one (1) year; and\n(b) The physician recommends the patient notify the spouse or sexual partner of\nthe positive test and refrain from engaging in sexual activity in a manner\nlikely to transmit the virus and the patient refuses;\n(c) If, pursuant to a perceived civil duty or the ethical guidelines of the\nprofession, the physician reasonably and in good faith advises the spouse of\nthe patient or sexual partner with whom the patient has cohabitated for more\nthan one (1) year of the positive test and facts concerning the transmission of\nthe virus; and\n(d) The physician reports information about HIV status to the Cabinet for Health\nand Family Services pursuant to administrative regulations promulgated by\nthe cabinet.\n(2) Notwithstanding the for egoing, a physician licensed pursuant to KRS Chapter 311\nshall not be civilly or criminally liable for failure to disclose information relating to\na positive test result for human immunodeficiency virus of a patient to a spouse.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30477","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:04Z","sha256":"116e5f4e615bba410d30cef0f5354dc9b49bf9bb54b38f06553a46e3872d1c25","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.281","next":"us-ky/krs-311.283"},"notice":"GroundRules: Original legal text.
