{"data":{"id":"us-ky/krs-311.555","jurisdiction":"us-ky","citation":"KRS 311.555","heading":"Legislative declaration of policy -- Standards for judicial review.","body":"It is the declared policy of the General Assembly of Kentucky that the practice of\nmedicine and osteopathy should be regulated and controlled as provided in KRS 311.530\nto 311.620 in order to prevent empiricism and to protect the health and safety of the\npublic. Further, the General Assembly of Kentucky has created the board, as defined in\nKRS 311.530, to function as an independent board, the majority of whose members are\nlicensed physicians, with the intent that such a peer group is best qualified to regul ate,\ncontrol and otherwise discipline the licensees who practice medicine and osteopathy\nwithin the Commonwealth of Kentucky. In furtherance of this intent, the judiciary of the\nCommonwealth of Kentucky, who may be caused to review the actions of the board, shall\nnot interfere or enjoin the board's actions until all administrative remedies are exhausted,\nand modify, remand, or otherwise disturb those actions only in the event that the action of\nthe board:\n(1) Constitutes a clear abuse of its discretion;\n(2) Is clearly beyond its legislative delegated authority; or\n(3) Violated the procedure for disciplinary action as described in KRS 311.591.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30520","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:04Z","sha256":"8f5bd48772d36493ebb9ab16998ba39c55d8ee67695078b48f532f97326dbf2f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.550","next":"us-ky/krs-311.560"},"notice":"GroundRules: Original legal text.
