{"data":{"id":"us-ky/krs-311.560","jurisdiction":"us-ky","citation":"KRS 311.560","heading":"Prohibition against practice of medicine or osteopathy without","body":"license -- Exceptions.\n(1) Except as provided in subsection (2) of this section, no person shall engage or\nattempt to engage in the practice of medicine or osteopathy within this state, or\nopen, maintain, or occupy an office or place of business within this state for\nengaging in practice, or in any manner announce or express a readiness to\nengage  in practice within this state, unless the person holds a valid and\neffective license or permit issued by the board as hereinafter provided.\n(2) The provisions of subsection (1) of this section shall not apply to:\n(a) Commissioned  medical officers of the Armed Forces of the United States,\nor medical officers of the United States Public Health Service, the United\nStates Department of Veterans Affairs, and  other agencies of the\ngovernment  of the United States of America, while said persons are\nengaged  in the performance, within this state, of their official duties under\nfederal laws;\n(b) 1. Persons who, being nonresidents of Kentucky and lawfully licensed\nto  practice medicine or osteopathy in their states of actual\nresidence, infrequently engage  in the practice of medicine or\nosteopathy within this state, when called to see or attend particular\npatients in consultation and association with a physician licensed\npursuant to this chapter; or\n2. Persons  who, being current participants in a medical residency\nprogram  outside of Kentucky and  lawfully licensed to practice\nmedicine or osteopathy in the states of their medical residency\nprograms, who participate in a temporary residency rotation of no\nmore  than sixty (60) days at a hospital in this Commonwealth.  All\npersons who participate in a temporary residency rotation under this\nparagraph shall register with the board at no cost, on forms provided\nby the board, and shall be subject to the jurisdiction of the board for\nso long as they participate in the residency rotation. Persons who\nwish to participate in a second or subsequent temporary residency\nrotation under this paragraph shall seek advance approval of the\nboard;\n(c) Graduates of medical or osteopathic schools approved by the board,\nwhile  engaged  in performing supervised internship or  first-year\npostgraduate training approved by the board at hospitals in this state. All\nfirst-year postgraduate trainees shall register with the board at no cost, on\nforms provided by the board. No  first-year postgraduate trainee shall\nviolate the provisions of KRS  311.595 or KRS  311.597, and any first-year\npostgraduate trainee who  is released or discharged from a training\nprogram for a reason that falls within KRS  311.595 or 311.597 shall be\nreported by the program director to the board. A residency physician who\nparticipates in a temporary residency rotation under paragraph (b) of this\nsubsection shall not be required to obtain a license under KRS  311.530 to\n311.620;\n(d) Physicians employed by a sports entity visiting Kentucky for a specific\nsporting event when the physician holds an active medical or osteopathic\nlicense in another state and limits the practice of medicine in Kentucky to\nmedical treatment of the members, coaches, and staff of the sports entity\nthat employs the physician; or\n(e) Persons  who  are nonresidents of Kentucky and licensed to practice\nmedicine or osteopathy in their states of residence and are providing\nmedical services as a charitable health-care provider in Kentucky through\na nonprofit, all-volunteer sponsoring organization as provided for under\nKRS  216.940 to 216.945, after confirming to the board that their licenses\nare currently in good standing in their states of residence and having\nbeen  issued a written waiver by the board to provide these services\nduring the specific period stated in the written waiver.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45843","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:04Z","sha256":"bd798d96747ab678a1db923e51b3100158abb45898e53720439d0067f6cdedfc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.555","next":"us-ky/krs-311.565"},"notice":"GroundRules: Original legal text.
