{"data":{"id":"us-ky/krs-311.599","jurisdiction":"us-ky","citation":"KRS 311.599","heading":"Mental or physical examination of physician -- Effect of failure to submit","body":"to examination -- Opportunity to have license renewed.\n(1) When a hearing or inquiry panel has probable cause to believe a physician is\nsuffering from a physical or mental cond ition that might impede his ability to\npractice competently, the panel may order the physician to undergo a physical or\nmental examination by persons designated by the panel.\n(2) Failure of a physician to submit to such an examination when directed, unless  the\nfailure was due to circumstances beyond his control, shall constitute an admission\nthat the concerned physician has developed such a physical or mental disability, or\nother conditions, that continued practice is dangerous to patients or to the public;\nsaid failure shall constitute a default and a final order may be entered without the\ntaking of testimony or presentation of evidence.\n(3) A physician whose license has been suspended, limited, restricted or revoked under\nthis section and KRS 311.595(8), s hall at reasonable intervals be afforded an\nopportunity to demonstrate that he can resume the competent practice of medicine\nwith reasonable skill and safety to patients.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30541","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:04Z","sha256":"c8fffcb4b7d91e5329dc005d4e38108e7ace73be2efc3812d225eb0392ca8db9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.598","next":"us-ky/krs-311.600"},"notice":"GroundRules: Original legal text.
