{"data":{"id":"us-ky/krs-311.604","jurisdiction":"us-ky","citation":"KRS 311.604","heading":"Clinical competency examination and skills assessment program --","body":"Demonstration of competency to resume practice.\n(1) When a hearing or inquiry panel receives information that a physician has not been\nengaged in the active practice of medicine for at l east two (2) years, the panel may\norder the physician to successfully complete a board -approved clinical competency\nexamination or a board -approved clinical skills assessment program at the expense\nof the physician. The panel shall review the results of th e examination or\nassessment and determine whether the physician may resume the practice of\nmedicine without undue risk or danger to patients or the public.\n(2) Failure of a physician to successfully complete the clinical competency examination\nor the clinical skills assessment when directed shall constitute an admission that the\nphysician is unable to practice medicine according to accepted and prevailing\nstandards, unless the failure was due to circumstances beyond the control of the\nphysician. The failure  shall constitute a default and a final order may be entered\nwithout additional testimony or without presentation of additional evidence.\n(3) A physician whose license has been suspended, limited, restricted, or revoked under\nthis section or KRS 311.595(8)  shall be afforded an opportunity at reasonable\nintervals to demonstrate that he or she has the competency and skill to resume the\npractice of medicine.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30546","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:05Z","sha256":"aa0e2a3723ab524fcc6f316cd51d0c8139ce062a9fb733bf4c96faca94d508f3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.603","next":"us-ky/krs-311.605"},"notice":"GroundRules: Original legal text.
