{"data":{"id":"us-ky/krs-311.619","jurisdiction":"us-ky","citation":"KRS 311.619","heading":"Confidentiality and privileged status of program's records.","body":"(1) All information, interviews, reports, statements, memoranda, or other documents\nfurnished to or produced by the program formed under KRS 311.616, as well as all\ncommunications to or from the program, and any findings, conclusions,\ninterventions, treatment,  or rehabilitation, or other proceedings of the program\nwhich in any way pertain or refer to an individual licensed by the board who may\nbe, or who is actually, impaired shall be privileged and confidential.\n(2) All records and proceedings of the program w hich pertain or refer to an individual\nlicensed by the board who may be, or who actually is, impaired shall be privileged\nand confidential and shall be used by the program and its members only in the\nexercise of the proper function of the program and shall  not be considered public\nrecords nor shall they be subject to court subpoena or subject to discovery or\nintroduction as evidence in any civil, criminal, or administrative proceedings except\nas described in subsection (3) of this section.\n(3) The program m ay disclose information relative to an impaired individual licensed\nby the board only:\n(a) When it is essential to disclose such information to further the intervention,\ntreatment, or rehabilitation needs of the impaired individual, and then only to\nthose persons or organizations with a need to know;\n(b) When its release is authorized in writing by the impaired individual; or\n(c) When the program is required to make a report to the board.\n(4) The program shall report any suspected violation of KRS 311.595 to the board.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50104","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:05Z","sha256":"a95e111826784a7b56797a9f627f36c8da110b3a16465f8481769ea315b20a54","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.618","next":"us-ky/krs-311.6191"},"notice":"GroundRules: Original legal text.
