{"data":{"id":"us-ky/krs-311.633","jurisdiction":"us-ky","citation":"KRS 311.633","heading":"Notification to attending physician and health care facility of existing","body":"advance directive or medical order for scope of treatment -- Effect of refusal to\ncomply -- Unlawful discriminatory practices.\n(1) It shall be the responsibility of the grantor  or the responsible party of the grantor to\nprovide for notification to the grantor's attending physician and health care facility\nwhere the grantor is a patient that an advance directive or a medical order for scope\nof treatment has been made. If the gran tor is comatose, incompetent, or otherwise\nmentally or physically incapable, any other person may notify the attending\nphysician of the existence of an advance directive or a medical order for scope of\ntreatment. An attending physician who is notified shal l promptly make the living\nwill directive or a copy of the advance directive or a medical order for scope of\ntreatment a part of the grantor's medical records.\n(2) An attending physician or health care facility which refuses to comply with the\nadvance directive or a medical order for scope of treatment made pursuant to KRS\n311.6225 of a patient or decision made by a surrogate or responsible party shall\nimmediately inform the patient or the patient's responsible party and the family or\nguardian of the patien t of the refusal. No physician or health care facility which\nrefuses to comply with the advance directive or medical order for scope of treatment\nof a qualified patient or decision made by a responsible party shall impede the\ntransfer of the patient to ano ther physician or health care facility which will comply\nwith the advance directive or medical order for scope of treatment. If the patient, the\nfamily, or the guardian of the patient has requested and authorized a transfer, the\ntransferring attending phys ician and health care facility shall supply the patient's\nmedical records and other information or assistance medically necessary for the\ncontinued care of the patient, to the receiving physician and health care facility.\n(3) No physician, nurse, staff mem ber, or employee of a public or private hospital, or\nemployee of a public or private health care facility, who shall state in writing to the\nhospital or health care facility his objection to complying with the advance directive\nof a patient, a health care decision of a responsible party under KRS 311.621 to\n311.643, or a medical order for scope of treatment under KRS 311.6225, on moral,\nreligious, or professional grounds, shall be required to, or held liable for refusal to,\ncomply with the advance directive , health care decision, or medical order for scope\nof treatment as long as the physician, nurse, staff member, or employee complies\nwith the requirements of subsection (2) of this section regarding patient notification\nand patient transfer.\n(4) It shall be  unlawful discriminatory practice for any person to impose penalties or\ntake disciplinary action against or deny or limit licenses, certifications, degrees, or\nother approvals or documents of qualification to any physician, nurse, staff member,\nor employee who refuses to comply with the advance directive of a patient, a health\ncare decision by a responsible party under KRS 311.621 to 311.643, or a medical\norder for scope of treatment, as long as the physician, nurse, staff member, or\nemployee complies with the provisions of subsection (2) of this section regarding\nnotification and transfer.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44037","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:05Z","sha256":"773ac8c87eb3a96448b5d63c1e776b97882ebbcdc1043ca2e409b76e7709de88","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.632","next":"us-ky/krs-311.634"},"notice":"GroundRules: Original legal text.
