{"data":{"id":"us-ky/krs-311.646","jurisdiction":"us-ky","citation":"KRS 311.646","heading":"Prescription injectable epinephrine auto -injectors and bronchodilator","body":"rescue inhalers.\n(1) A health -care practitioner may prescribe injectable epinephrine devices and\nbronchodilator rescue inhalers in the name of an authorized entity or to a certified\nindividual for use in accordance with this section.\n(2) A pharmacist may dispense injectable epinephrine devices and bronchodilator\nrescue inhalers pursuant to a prescription issued in the name of an authorized entity\nor to a certified individual.\n(3) The Department for Public Health, the Kentucky Board of Medical Licensure, the\nKentucky Board of Nursing, the American Red Cross, or other training programs\napproved by the Department for Public Health may conduct in -person or on -line\ntraining for administering lifesaving treatment to persons believed in good faith to\nbe experiencing severe allergic reactions and asthma symptoms or respiratory\ndistress and issue a certificate of training to persons completing the training. The\ntraining shall include instructions for recognizing the symptoms of anaphylaxis and\nasthma and administering an injectable epinephrine device or a bronchodilator\nrescue inhaler.\n(4) An individual who has a certificate issued under this section may:\n(a) Receive a prescription fo r injectable epinephrine devices and bronchodilator\nrescue inhalers from a health-care practitioner;\n(b) Possess prescribed injectable epinephrine devices and bronchodilator rescue\ninhalers; and\n(c) In an emergency situation when a physician is not immedia tely available and\nthe certified individual in good faith believes a person is experiencing a severe\nallergic reaction, asthma symptoms, or respiratory distress regardless of\nwhether the person has a prescription for an injectable epinephrine device or a\nbronchodilator rescue inhaler or has previously been diagnosed with an allergy\nor asthma:\n1. Administer an injectable epinephrine device or a bronchodilator rescue\ninhaler to the person; and\n2. Provide an injectable epinephrine device or a bronchodilator re scue\ninhaler to the person for immediate self-administration.\n(5) An authorized entity that acquires and stocks a supply of injectable epinephrine\ndevices or bronchodilator rescue inhalers with a valid prescription shall:\n(a) Store the injectable epinephri ne devices and bronchodilator rescue inhalers in\naccordance with manufacturer's instructions and with any additional\nrequirements established by the department; and\n(b) Designate an employee or agent who holds a certificate issued under this\nsection to be responsible for the storage, maintenance, and general oversight\nof injectable epinephrine devices and bronchodilator rescue inhalers acquired\nby the authorized entity.\n(6) Any individual or entity who administers or provides an injectable epinephrine\ndevice to a person who is experiencing a severe allergic reaction shall contact the\nlocal emergency medical services system as soon as possible.\n(7) Any individual or entity who acquires and stocks a supply of injectable epinephrine\ndevices in accordance with this section shall notify an agent of the local emergency\nmedical services system and the local emergency communications or vehicle\ndispatch center of the existence, locatio n, and type of the injectable epinephrine\ndevices acquired if a severe allergic reaction has occurred.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51245","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:05Z","sha256":"a129b01bb1a4f276fe78843545fe5eeed75b9e93a3423c6694f4f950652e4963","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.645","next":"us-ky/krs-311.647"},"notice":"GroundRules: Original legal text.
