{"data":{"id":"us-ky/krs-311.647","jurisdiction":"us-ky","citation":"KRS 311.647","heading":"Immunity from civil liability for rendering emergency care or treatment","body":"with injectable epinephrine auto-injector or bronchodilator rescue inhaler.\n(1) Any individual or entity who, in good faith and without compensation, renders\nemergency care or treatment by the use of an injectable epinephrine device or a\nbronchodilator rescue inhaler shall be immune from civil liability for any personal\ninjury as a result of the care or treatment, or as a result of any act or failure to act in\nproviding or arranging further medical treatment, if the person acts as an ordinary,\nreasonable prudent person would have acted under the same or similar\ncircumstances.\n(2) The immunity from civil liability for any personal injury under subsection (1) of this\nsection includes:\n(a) A health-care practitioner who prescribes or authorizes the emergency use of\nthe injectable epinephrine device or bronchodilator rescue inhaler;\n(b) A pharmacist who fills a prescription for the injectable epinephrine device or\nbronchodilator rescue inhaler;\n(c) A certified individual who provides or administers the injectable epinephrine\ndevices or bronchodilator rescue inhaler;\n(d) An authorized entity who stores or provides the injectable epinephrine device\nor bronchodilator rescue inhale r to a certified individual or authorized\nnoncertified individual; and\n(e) An individual trainer or training entity providing the certified individual.\n(3) The immunity from civil liability under subsection (1) of this section shall not apply\nif the person al injury results from the gross negligence or willful or wanton\nmisconduct of the person rendering the emergency care.\n(4) The requirements of KRS 311.646(6) shall not apply to any individual who provides\nor administers an injectable epinephrine device or  a bronchodilator rescue inhaler if\nthat individual is acting as a Good Samaritan under KRS 313.035 and 411.148.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51246","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:05Z","sha256":"5e694c5dc046de8debfd2c34619c46c335c14beca23b41ff5e1b107bf09b54ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.646","next":"us-ky/krs-311.650"},"notice":"GroundRules: Original legal text.
