{"data":{"id":"us-ky/krs-311.674","jurisdiction":"us-ky","citation":"KRS 311.674","heading":"Licensure as an acupuncturist -- Approval and denial of applications","body":"-- Renewal -- Reciprocity.\n(1) To be licensed by the board as an acupuncturist, an applicant shall:\n(a) Submit an application approved by the board, with all sections completed,\nwith the required fee;\n(b) Be  of good character and reputation, if in accordance with KRS  Chapter\n335B;\n(c) Have  achieved a  passing score on  the acupuncture examination\nadministered by the National Commission for Certification of Acupuncture\nand Oriental Medicine; and\n(d) Have  graduated from a course of training of at least one thousand eight\nhundred (1,800) hours, including three hundred (300) clinical hours, that\nis approved by the Accreditation Commission  for Acupuncture and\nOriental Medicine.\nAll provisions of this subsection, including graduation from an approved course\nof training as specified in paragraph (d) of this subsection, must be met by all\napplicants before initial licensure as an acupuncturist may be granted.\n(2) An  acupuncturist who is legally authorized to practice acupuncture in another\nstate and who is presently in good standing in that other state may be licensed\nby endorsement from the state of his or her credentialing if that state has\nstandards substantially equivalent to those of this Commonwealth.\n(3) The  board may  request any reasonable information from the applicant and\nfrom collateral sources that is necessary for the board to make  an informed\ndecision. The applicant will execute any necessary waiver or release so that\nthe board may  obtain necessary information from collateral sources. An\napplication will be considered completed when the applicant has fully answered\nall sections of the approved application and the board has received all\nnecessary additional information from the applicant and collateral sources.\n(4) An  acupuncturist's license shall be  renewed  every two (2) years upon\nfulfillment of the following requirements:\n(a) The applicant has submitted a renewal application approved by the board\nwithin the time specified, with all sections completed, with the required\nfee; and\n(b) The applicant is of good character and reputation.\n(5) The  board shall notify each applicant in writing of the action it takes on an\napplication within one hundred twenty (120) days following the board's receipt\nof a completed application.\n(6) Notwithstanding any of the requirements for licensure established in this\nsection, and after providing the applicant with reasonable notice of its intended\naction and after providing a reasonable opportunity to be heard, the board may\ndeny licensure to an applicant without a prior evidentiary hearing upon a finding\nthat the applicant has violated any provision of this section or is otherwise unfit\nto practice. If the board denies an application, it shall notify the applicant of the\ngrounds on which the denial is based.
