{"data":{"id":"us-ky/krs-311.684","jurisdiction":"us-ky","citation":"KRS 311.684","heading":"Revocation of license -- Written admonishment -- Other disciplinary","body":"proceedings.\n(1) The board may:\n(a) Revoke a license;\n(b) Suspend a license for a period not to exceed five (5) years;\n(c) Deny an application for a license;\n(d) Decline to renew a license;\n(e) Indefinitely restrict or limit a license;\n(f) Issue a fine of up to two thousand dollars ($2,000) per violation and/or the\ncosts of the proceedings;\n(g) Place a license on probation for a period not to exceed five (5) years;\n(h) Reprimand the acupuncturist; or\n(i) Impose any combination of such sanctions, upon proof that the acupuncturist\nhas:\n1. Knowingly made or presented or caused to be made or presented any\nfalse, fraudulent, or forged statement, writing, certificate, diploma, or\nother document relating to an application for licensure;\n2. Practiced, aided, or abetted in the practice of fraud, forgery, deception,\ncollusion, or conspiracy relating to an examination for licensure;\n3. Entered a guilty or nolo contendere plea, or been convicted, by any court\nwithin or without the Commonwealth of Kentucky, of committing an act\nwhich is or would be a felony under the laws of the Commonwealth of\nKentucky or of the United States;\n4. Entered a guilty or nolo contendere plea, or been convicted, by any court\nwithin or without the Commonwealth of Kentucky, of any misdemeanor\noffense which has dishonesty as a fundamental and necessary element,\nincluding but not limited to crimes involving theft, e mbezzlement, false\nswearing, perjury, fraud, or misrepresentation;\n5. Become addicted to, or is an abuser of, alcohol, drugs, or any illegal\nsubstance;\n6. Developed a physical or mental disability or other condition that\npresents a danger in continuing to practice acupuncture to patients, the\npublic, or other health-care personnel;\n7. Knowingly made, caused to be made, or aided or abetted in the making\nof a false statement in any document executed in connection with the\npractice of acupuncture;\n8. Aided, as sisted, or abetted the unlawful practice of medicine or\nacupuncture;\n9. Willfully violated a confidential communication;\n10. Performed the services of an acupuncturist in an unprofessional,\nincompetent, or grossly or chronically negligent manner;\n11. Been removed, suspended, expelled, or placed on probation by any\nhealth-care facility or professional society for unprofessional conduct,\nincompetence, negligence, or violation of any provision of this section;\n12. Violated any applicable provision of a statute  or administrative\nregulation relating to acupuncture practice;\n13. Violated any term of a final order or agreed order issued by the board; or\n14. Failed to complete the required number of hours of approved continuing\neducation.\n(2) All disciplinary procee dings against an acupuncturist shall be conducted in\naccordance with KRS 311.591, 311.592, 311.593, 311.599, and KRS Chapter 13B\nand related administrative regulations promulgated under KRS Chapter 311.\n(3) (a) The board may issue a written admonishment to  the licensed acupuncturist\nwhen, in the judgment of the board:\n1. An alleged violation is not of a serious nature; and\n2. The evidence presented to the board after the investigation, including an\nappropriate opportunity for the licensed acupuncturist to r espond,\nprovides a clear indication that the alleged violation did in fact occur.\n(b) A copy of the admonishment shall be placed in the permanent file of the\nlicensed acupuncturist.\n(c) The licensed acupuncturist shall have the right to file a response to the\nadmonishment within thirty (30) days of its receipt and to have the response\nplaced in the permanent licensure file.\n(d) The licensed acupuncturist may alternatively, within thirty (30) days of the\nadmonishment's receipt, file a request for a hearing with the board.\n(e) Upon receipt of a request for a hearing, the board shall set aside the written\nadmonishment and set the matter for a hearing under the provisions of KRS\nChapter 13B.\n(4) At any time during the investigative or hearing processes, the boar d may enter into\nan agreed order or accept an assurance of voluntary compliance with the licensed\nacupuncturist which effectively deals with the complaint.\n(5) The board may, upon the agreement of the aggrieved party, use mediation to handle\ndisciplinary matters. The board may appoint any member or members of the board,\nany staff member, or any other person or combination thereof to serve in the\nmediation process.\n(6) The board may reconsider, modify, or reverse its disciplinary actions.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43061","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"b3c40c4da8bba6bd1f6bd8929dadc0bbfec8df011ab2f0b719fe21050e362ee7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.683","next":"us-ky/krs-311.685"},"notice":"GroundRules: Original legal text.
