{"data":{"id":"us-ky/krs-311.699","jurisdiction":"us-ky","citation":"KRS 311.699","heading":"Powers of board regarding genetic counselors -- Administrative","body":"regulations -- Kentucky Genetic Counselors Advisory Committee -- Duties.\n(1) The board shall exercise all the administrative functions of the state in the\nprevention of empiricism and  in the regulation of genetic counselors, which shall\ninclude but not be limited to promulgation of reasonable administrative regulations\nenabling the board to regulate the conduct of genetic counselor licensees. The board\nshall also:\n(a) Promulgate reasonable administrative regulations establishing moral, physical,\nintellectual, educational, scientific, technical, and professional qualifications\nof applicants for licensure or permits that may be issued by the board; and\n(b) Prescribe and collect reasonable fees and charges for the issuance and renewal\nof licenses.\n(2) There is hereby created the Kentucky Genetic Counselors Advisory Committee,\ncomposed of seven (7) members appointed by the board from a list of nine (9)\nnames submitted by the Kentucky Associa tion of Genetic Counselors or its\nsuccessor. The committee shall review and make recommendations to the board\nregarding all matters relating to genetic counselors, including but not limited to:\n(a) Applications for licensure;\n(b) Licensure renewal requirements;\n(c) Disciplinary investigations or action, when specifically requested by one (1) of\nthe board's panels established under KRS 311.591; and\n(d) Promulgation of administrative regulations.\n(3) Members of the committee shall be appointed by the board fo r four (4) year terms,\nexcept for initial appointments, and shall consist of:\n(a) Four (4) practicing licensed genetic counselors who shall each be selected for\neach vacancy from a list of at least six (6) licensed genetic counselors\nsubmitted by the Kentu cky Association of Genetic Counselors or its\nsuccessor;\n(b) One (1) supervising physician;\n(c) One (1) member of the board; and\n(d) One (1) citizen at large.\n(4) The chair of the committee shall be a licensed genetic counselor elected by a\nmajority vote of the committee members and shall preside over meetings. Meetings\nshall be held quarterly at a time and place within the Commonwealth as designated\nby the chair. Additional meetings may be held at the call of the chair or upon the\nwritten request of three (3) committee members.\n(5) Initial appointments shall be for staggered terms. Three (3) members shall serve a\nfour (4) year term, three (3) members shall serve a two (2) year term, and one (1)\nmember shall serve a one (1) year term.\n(6) Members of the committee shall not be compensated for their service but shall\nreceive reimbursement for expenditures relating to attendance at committee\nmeetings, consistent with state policies for the reimbursement of travel expenses for\nstate employees.\n(7) A committee member may be removed by the board for good cause or if he or she\nmisses two (2) consecutive committee meetings without good cause.\n(8) Upon the death, resignation, or removal of any member, the vacancy for the\nunexpired term shall be fille d by the board in the same manner as the original\nappointment.\n(9) The quorum required for any meeting of the committee shall be four (4) members.\nNo action by the committee or its members shall have any effect unless a quorum of\nthe committee is present at the meeting where the action is taken.\n(10) The board shall not be required to implement or adopt the recommendations of the\ncommittee.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46502","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"82a5e5f4b30182a5bcdd253c7742d5f4df2e244e2bc1fb5a49ae8c32747f293e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.697","next":"us-ky/krs-311.700"},"notice":"GroundRules: Original legal text.
