{"data":{"id":"us-ky/krs-311.710","jurisdiction":"us-ky","citation":"KRS 311.710","heading":"Legislative findings.","body":"The General Assembly of the Commonwealth of Kentucky hereby finds and declares:\n(1) That it is in the interest of the people of the Commonwealth of Kentucky that every\nprecaution be taken to insure the protection of every viable unborn child being\naborted, and every precaution be taken to provide life -supportive procedures to\ninsure the unborn child its continued life after its abortion; and\n(2) That currently, in the Commonwealth, there is inadequate legislation to protect the\nlife, health and welfare of pregnant women and unborn human life; and\n(3) That it is in the interest of the people of the Commonwealth of Kentucky to\nmaintain accurate statistical data to aid in providing proper maternal health\nregulations.\n(4) It is the intention of the General Assem bly of the Commonwealth of Kentucky to\nassure the integrity and autonomy of a woman's decision whether to submit to an\nabortion or to carry her child to term, to protect the rights and interests of a minor\nincompetent woman and her parents in the context o f abortion, to further the\nCommonwealth's compelling interest in protecting the formal integrity of the\nmarital relation and the procreative rights and interests of the husband, and to\nprovide for the development of statistical data. The General Assembly f inds as fact\nthat the rights and interests furthered by this chapter are not secure in the context in\nwhich abortion is presently performed.\n(5) It is the present intention of the General Assembly to protect the valid and\ncompelling interests of the Common wealth and its inhabitants without unduly\nburdening a woman's constitutional privacy rights as delineated by the courts. If,\nhowever, the United States Constitution is amended or relevant judicial decisions\nare reversed or modified, the declared policy of this Commonwealth to recognize\nand to protect the lives of all human beings regardless of their degree of biological\ndevelopment shall be fully restored.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30625","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"5b4a6cba718fb445246ed64d918202a53f03d5f24670a9919da8a5995c733f0b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.705","next":"us-ky/krs-311.715"},"notice":"GroundRules: Original legal text.
