{"data":{"id":"us-ky/krs-311.7704","jurisdiction":"us-ky","citation":"KRS 311.7704","heading":"Determination of fetal heartbeat -- Medical records -- Option to view","body":"or hear heartbeat -- Administrative regulations -- Persons not in violation.\n(1) (a) A  person who intends to perform or induce an abortion on a pregnant\nwoman  shall determine whether there is a detectable fetal heartbeat of\nthe unborn human individual the pregnant woman  is carrying. The method\nof determining the presence of a fetal heartbeat shall be consistent with\nthe person's good-faith understanding of standard medical practice,\nprovided that if administrative regulations have been promulgated under\nsubsection (2) of this section, the method chosen shall be one that is\nconsistent with the regulations.\n(b) The person who determines the presence or absence of a fetal heartbeat\nshall record in the pregnant woman's  medical record the estimated\ngestational age of the unborn human  individual, the method used to test\nfor a fetal heartbeat, the date and time of the test, and the results of the\ntest.\n(c) The  person who performs the examination for the presence of a fetal\nheartbeat shall give the pregnant woman  the option to view or hear the\nfetal heartbeat.\n(2) The secretary of the Cabinet for Health and Family Services may promulgate\nadministrative regulations specifying the appropriate methods of performing an\nexamination for the purpose of determining the presence of a fetal heartbeat of\nan  unborn human  individual based  on  standard medical practice. The\nregulations shall require only that an  examination shall be  performed\nexternally.\n(3) A person is not in violation of subsection (1) or (2) of this section if:\n(a) The person has performed an examination for the purpose of determining\nthe presence of a fetal heartbeat of an unborn human  individual utilizing\nstandard medical practice;\n(b) The examination does not reveal a fetal heartbeat or the person has been\ninformed by a physician who has performed the examination for a fetal\nheartbeat that the examination did not reveal a fetal heartbeat; and\n(c) The  person notes in the pregnant woman's  medical records the\nprocedure utilized to detect the presence of a fetal heartbeat.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48501","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"4e4d0f947471dc1ecb4c11cda08b38e997734039b17b7ea6485ee8291c898923","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.7703","next":"us-ky/krs-311.7705"},"notice":"GroundRules: Original legal text.
