{"data":{"id":"us-ky/krs-311.7731","jurisdiction":"us-ky","citation":"KRS 311.7731","heading":"Definitions for KRS  311.7731 to 311.7739.","body":"As used in KRS 311.7731 to 311.7739, unless the context otherwise requires:\n(1) \"Abortion\" has the same meaning as in KRS 311.720;\n(2) \"Abortion-inducing drug\" means  a medicine, drug, or any other substance or\ncombination of substances prescribed or dispensed with the intent of\nterminating the clinically diagnosable pregnancy of a woman, with knowledge\nthat the termination will, with reasonable likelihood, cause the death of the\nunborn  child. This includes the off-label use  of drugs known  to have\nabortion-inducing properties, which are prescribed specifically with the intent of\ncausing an abortion, such as mifepristone (mifeprex), misoprostol (cytotec),\nand methotrexate, or any generic or therapeutic equivalents thereof. The use of\nsuch  drugs to induce abortion is also known  as \"medical,\" \"medication,\"\n\"RU\u0013486,\" \"mifeprex regimen,\" or \"drug-induced\" abortion. This definition does\nnot apply to drugs that may  be known to cause an abortion but which are\nprescribed for other medical indications (e.g., chemotherapeutic agents,\ndiagnostic drugs, etc.);\n(3) \"Adverse event\" means, as defined by the Food and Drug Administration in 21\nC.F.R. sec. 312.32, any untoward medical occurrence associated with the use\nof a drug in humans, whether or not considered drug-related. \"Adverse event\"\ndoes not include an adverse event or suspected adverse reaction that, had it\noccurred in a more severe form, might have caused death;\n(4) \"Associated physician\" means a physician who has entered into an associated\nphysician agreement established in KRS 216B.206;\n(5) \"Cabinet\" means the Cabinet for Health and Family Services;\n(6) \"Complication\" or \"abortion complication\" means only the following physical or\npsychological conditions which, in the reasonable medical judgment of a\nlicensed healthcare professional, arise as a primary or secondary result of an\ninduced abortion: uterine perforation, cervical laceration, infection, vaginal\nbleeding that qualifies as a Grade 2 or higher adverse event according to the\nCommon  Terminology Criteria for Adverse Events, pulmonary embolism, deep\nvein thrombosis, failure to actually terminate the pregnancy, incomplete\nabortion (retained tissue), pelvic inflammatory disease, missed  ectopic\npregnancy, cardiac arrest, respiratory arrest, renal failure, shock, amniotic fluid\nembolism,  coma,  death, free fluid in the abdomen,  allergic reactions to\nanesthesia and  abortion-inducing drugs, psychological complications as\ndiagnosed that are listed in the current Diagnostic and Statistical Manual of\nMental Disorders, and any other \"adverse event\" as defined by the Food and\nDrug Administration criteria provided in the MedWatch  Reporting System;\n(7) \"Gestational age\" has the same meaning as in KRS 311.7701;\n(8) \"Hospital\" has the same meaning as in KRS 311.720;\n(9) \"Manufacturer\" or \"distributor\" means  an individual or entity that creates,\nproduces, supplies, transports, or sells drugs, including any substances:\n(a) Recognized by an official pharmacopoeia or formulary;\n(b) Intended for use  in the diagnosis, cure, mitigation, treatment, or\nprevention of disease;\n(c) Other than food, intended to affect the structure or any function of the\nbody; and\n(d) Intended for use as a component of a medicine but not a device or a\ncomponent, part, or accessory of a device;\n(10) \"Nonsurgical abortion provider\" means a qualified physician who is registered\nwith the Cabinet for Health and Family Services;\n(11) \"Physician\" has the same meaning as in KRS 311.720;\n(12) \"Pregnancy\" or \"pregnant\" has the same meaning as intrauterine pregnancy as\ndefined in KRS 311.7701;\n(13) \"Provide\" or \"provision\" means  any  act of giving, selling, dispensing,\nadministering, transferring possession, delivering, transporting to, or otherwise\nproviding or prescribing an abortion-inducing drug;\n(14) \"Qualified physician\" means a physician who is credentialed and competent to:\n(a) Identify and document a viable intrauterine pregnancy;\n(b) Assess  the gestational age of pregnancy and to inform the patient of\ngestational age-specific risks;\n(c) Diagnose ectopic pregnancy;\n(d) Determine blood type and administer the prevailing medical standard of\ncare to prevent harmful fetal or child outcomes or Rh incompatibility in\nfuture pregnancies if a pregnant patient is Rh negative;\n(e) Assess  for signs of domestic abuse, reproductive control, human\ntrafficking, and other signals of coerced abortion;\n(f) Provide surgical intervention or has entered into a contract with another\nqualified physician to provide surgical intervention; and\n(g) Supervise and bear legal responsibility for any agent, employee, or\ncontractor who is participating in any part of the procedure, including but\nnot limited to pre-procedure evaluation and care; and\n(15) \"Unborn child\" has the same meaning as in KRS 311.781.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52217","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"a4cf3964cc8808666c6fc26a525e8bc68df34ac591635f416dabc6ce6560a532","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.772","next":"us-ky/krs-311.7733"},"notice":"GroundRules: Original legal text.
