{"data":{"id":"us-ky/krs-311.7739","jurisdiction":"us-ky","citation":"KRS 311.7739","heading":"Legal actions upon failure to comply with KRS  311.7731 to 311.7739.","body":"(1) In addition to the remedies available under the laws in this state, failure to\ncomply with KRS 311.7731 to 311.7739 shall:\n(a) Provide a basis for a civil malpractice action for actual and punitive\ndamages;\n(b) Provide a basis for a professional disciplinary action under KRS  411.167;\nand\n(c) Provide a basis for recovery for a pregnant patient's survivors for the\nwrongful death of the patient under KRS 411.130.\n(2) When  requested, the court shall allow a patient to proceed using only the\npatient's initials or a pseudonym  and may close any proceedings in the case\nand enter other protective orders to preserve the privacy of the patient upon\nwhom  the drug-induced abortion was attempted, induced, or performed.\n(3) If judgment is rendered in favor of the plaintiff, the court shall also render\njudgment for reasonable attorney's fees in favor of the plaintiff against the\ndefendant.\n(4) If judgment is rendered in favor of the defendant and the court finds that the\nplaintiff's suit was frivolous and brought in bad faith, the court may  render\njudgment for reasonable attorney's fees in favor of the defendant against the\nplaintiff.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52223","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"dd8cdfd3af6e60ca229874482070d4bcf4764e69b0224c7e0c01cd1c6097f6f0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.7737","next":"us-ky/krs-311.774"},"notice":"GroundRules: Original legal text.
