{"data":{"id":"us-ky/krs-311.783","jurisdiction":"us-ky","citation":"KRS 311.783","heading":"Required determination of unborn child's probable gestational age","body":"prior to abortion -- Penalty for violation -- Report.\n(1) Except in a medical emergency that prevents compliance with this section, no\nphysician shall intentionally perform or induce or intentionally attempt to\nperform or induce an abortion on a pregnant woman  unless, prior to the\nperformance or inducement of the abortion or the attempt to perform or induce\nthe abortion, the physician determines, in the physician's reasonable medical\njudgment, the unborn child's probable gestational age. The physician shall\nmake  that determination after making inquiries of the pregnant woman  and\nperforming any medical examinations or tests of the pregnant woman  the\nphysician  considers necessary  as  a  reasonably  prudent  physician,\nknowledgeable  about the case  and  medical conditions involved, would\nconsider necessary to determine the unborn child's probable gestational age.\n(2) Except in a medical emergency that prevents compliance with this section, no\nphysician shall intentionally perform or induce or intentionally attempt to\nperform or induce an abortion on a pregnant woman  after the unborn child\nreaches the probable gestational age of fifteen (15) weeks without first entering\nthe determination made  in subsection (1) of this section and the associated\nfindings of the medical examination and tests in the medical record of the\npregnant woman.\n(3) The  state Board of Medical Licensure shall suspend a physician's license to\npractice medicine in this state for a period of not less than six (6) months if the\nphysician violates this section.\n(4) The  physician shall submit a report on a form provided by the cabinet that\nincludes at a minimum the information required by KRS 213.101 and:\n(a) The unborn child's probable gestational age determined by the physician;\nand\n(b) The  results of inquiries of the pregnant woman  and  any  medical\nexaminations or tests performed.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52239","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"ff5ef7d030488a4b551a7b8ded9313219f4d4c38fca5dafcca543795cf340350","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.782","next":"us-ky/krs-311.784"},"notice":"GroundRules: Original legal text.
