{"data":{"id":"us-ky/krs-311.787","jurisdiction":"us-ky","citation":"KRS 311.787","heading":"Prohibition of certain abortion procedures  when  the probable","body":"gestational age of the unborn child is 11 weeks or greater, except in the\ncase of a medical emergency  -- Penalty not to apply to pregnant woman.\n(1) As used in this section:\n(a) \"Bodily dismemberment,  crushing, or human  vivisection\" means  a\nprocedure in which a person, with the purpose of causing the death of an\nunborn child, dismembers the living unborn child and extracts portions,\npieces, or limbs of the unborn child from the uterus through the use of\nclamps, grasping forceps, tongs, scissors, or a similar instrument that,\nthrough the convergence of two (2) rigid levers, slices, crushes, or grasps,\nor performs any combination of those actions on, any portion, piece, or\nlimb of the unborn child's body to cut or separate the portion, piece, or\nlimb from the body. The term includes a procedure that is used to cause\nthe death of an unborn child and in which suction is subsequently used to\nextract portions, pieces, or limbs of the unborn child after the unborn\nchild's death;\n(b) \"Medical emergency\" has the same meaning as in KRS 311.720;\n(c) \"Probable gestational age\" has the same  meaning as in KRS  311.720;\nand\n(d) \"Unborn child\" has the same meaning as in KRS 311.781.\n(2) No  person shall intentionally perform or induce or attempt to perform or induce\nan abortion on a pregnant woman:\n(a) That  will result in the bodily dismemberment,  crushing, or human\nvivisection of the unborn child; and\n(b) When  the probable gestational age of the unborn child is eleven (11)\nweeks or greater;\nexcept in the case of a medical emergency.\n(3) A pregnant woman  on whom  an abortion is performed or induced or attempted\nto be performed or induced in violation of subsection (2) of this section is not\nguilty of violating subsection (2) of this section or of attempting to commit,\nconspiring to commit, or complicity in committing a violation of subsection (2) of\nthis section.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52248","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"b9dd28dcdee06a95f5e086421baa0b4c75e74f725f4d24d7fa1fe8b8d5bff617","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.786","next":"us-ky/krs-311.790"},"notice":"GroundRules: Original legal text.
