{"data":{"id":"us-ky/krs-311.821","jurisdiction":"us-ky","citation":"KRS 311.821","heading":"Definitions for KRS  311.821 to 311.827.","body":"As used in KRS 311.821 to 311.827:\n(1) \"Abortion\" has the same  meaning as in KRS  311.720. However, as used in\nKRS  311.821 to 311.827, an abortion shall not include the use of any means to\nterminate the pregnancy of a woman  if done with an intent to:\n(a) Save the life or preserve the health of the unborn child;\n(b) Remove  a dead unborn child caused by spontaneous abortion; or\n(c) Remove  an ectopic pregnancy;\n(2) \"Advanced  practice registered nurse\" has the same  meaning  as in KRS\n314.011;\n(3) \"Born-alive\" or \"live birth\" means  the complete expulsion or extraction of an\ninfant from his or her mother, regardless of the state of gestational\ndevelopment, who, after expulsion or extraction, whether or not the umbilical\ncord has been cut or the placenta is attached, and regardless of whether the\nexpulsion or extraction occurs as a result of natural or induced labor, cesarean\nsection, or induced abortion, shows any evidence of life, including but not\nlimited to one (1) or more of the following:\n(a) Breathing;\n(b) A heartbeat;\n(c) Umbilical cord pulsation; or\n(d) Definite movement of voluntary muscles;\n(4) \"Consent\" means the voluntary agreement or acquiescence by a person of age\nand with the requisite mental capacity who is not under duress or coercion and\nwho  has knowledge or understanding of the act or action to which he or she\nhas agreed or acquiesced;\n(5) \"Healthcare provider\" means any individual who may be asked to participate in\nany  way  in a healthcare service, including but not limited to a physician;\nphysician assistant; advanced practice registered nurse; nurse; nurse's aide;\nmedical  assistant; hospital employee;  clinic employee;  nursing home\nemployee; pharmacist; pharmacy employee; researcher; medical or nursing\nschool faculty or employee; or any professional, paraprofessional, or any other\nperson who furnishes or assists in the furnishing of healthcare services;\n(6) \"Infant\" means a child of the species homo sapiens who has been completely\nexpulsed or extracted from his or her mother, regardless of the stage of\ngestational development, until the age of thirty (30) days post birth;\n(7) \"Medical facility\" means  any public or private hospital, clinic, center, medical\nschool, medical training institution, healthcare facility, physician\u0019s office,\ninfirmary, dispensary, ambulatory surgical treatment center, or other institution\nor location where medical care is provided to any person;\n(8) \"Nurse\" has the same meaning as in KRS 314.011;\n(9) \"Physician\" has the same meaning as in KRS 311.720;\n(10) \"Physician assistant\" has the same meaning as in KRS 311.840; and\n(11) \"Unborn child\" has the same meaning as in KRS 311.781.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50602","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"644721627ef53e1ced94d404c00efba2b925f6ad321ddf72fb03b415b272e93e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.820","next":"us-ky/krs-311.822"},"notice":"GroundRules: Original legal text.
