{"data":{"id":"us-ky/krs-311.822","jurisdiction":"us-ky","citation":"KRS 311.822","heading":"Legislative findings -- Purposes of KRS  311.821 to 311.827.","body":"(1) The General Assembly of the Commonwealth  of Kentucky hereby finds that:\n(a) The  Commonwealth  of Kentucky has a paramount interest in protecting\nall human life;\n(b) If an attempted abortion results in the live birth of an infant, the infant is a\nlegal person for all purposes under the laws of this Commonwealth;\n(c) Irrespective of the status of court challenges to Kentucky statutes\nprotecting unborn children from abortion, it is not an infringement on a\nwoman's  asserted  right to  terminate her  pregnancy  for this\nCommonwealth  to affirm its interest in protecting an infant whose live birth\noccurred as the result of an attempted abortion; and\n(d) Without proper legal protection, newly born infants who survive attempted\nabortions may be denied appropriate life-saving or life-sustaining medical\ncare and treatment and may be left to die.\n(2) Based  on the findings in subsection (1) of this section, the purposes of KRS\n311.821 to 311.827 are to:\n(a) Ensure the protection and promotion of the health and well-being of all\ninfants born-alive in this Commonwealth; and\n(b) Mandate  that healthcare providers give medically appropriate and\nreasonable life-saving and life-sustaining medical care and treatment to\nall born-alive infants.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50603","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:06Z","sha256":"3ed8776fe88eb1fe705b4b056c2eb51ab963b2f1cb49a3ff7e6db80cbb3b727d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.821","next":"us-ky/krs-311.823"},"notice":"GroundRules: Original legal text.
