{"data":{"id":"us-ky/krs-311.890","jurisdiction":"us-ky","citation":"KRS 311.890","heading":"Revocation, suspension, denial, declination to renew, limitation,","body":"restriction of certification -- Fines, reprimands, probation.\n(1) The  board may revoke, suspend, deny, decline to renew, limit, or restrict the\ncertification of a surgical assistant, or may fine, reprimand, or place a surgical\nassistant on probation for no more than five (5) years upon proof that he or\nshe:\n(a) Has been convicted of a felony, if in accordance with KRS Chapter 335B;\n(b) Has  been  convicted of a misdemeanor, if in accordance with KRS\nChapter 335B;\n(c) Has been granted a certificate upon a mistake of a material fact;\n(d) Has violated any provision of KRS 311.864 to 311.890;\n(e) Has become drug addicted;\n(f) Has become a chronic or persistent alcoholic;\n(g) Has  developed such physical or mental disability, or other condition\nwhereby continued practice is dangerous to patients or to the public;\n(h) Has  violated any order or the terms or the conditions of any order issued\nby the board;\n(i) Has  engaged  in, or attempted to engage  in, practice as a surgical\nassistant under a false or assumed name;\n(j) Has willfully violated a confidential communication;\n(k) Has  acted in a grossly negligent or willful manner which is inconsistent\nwith practice as a surgical assistant;\n(l) Is unfit or incompetent to practice as a surgical assistant by reason of\ngross negligence or other causes, including but not limited to being\nunable to practice as a surgical assistant with reasonable skill or safety;\n(m) Has had a license or certificate to practice as a surgical assistant denied,\nlimited, suspended, probated, or revoked in another jurisdiction;\n(n) Has engaged in conduct likely to deceive or defraud the public;\n(o) Has  knowingly made  or presented or caused to be made  or presented\nany false, fraudulent, or forged statement, writing, certificate, diploma, or\nother document relating to an application for certification;\n(p) Has exceeded the scope of practice of surgical assisting delegated by the\ndelegating physician; or\n(q) Has  exceeded the scope of practice for which the surgical assistant was\ncredentialed by the governing board of a hospital or licensed health care\nfacility.\n(2) The board may impose a fine of up to five hundred dollars ($500) per violation\nas  part of a disciplinary action and may  require the surgical assistant to\nreimburse the board for all costs of the proceedings.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46808","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:07Z","sha256":"30902986a0390cf764e771aa2b673eb5c6b60eb8727783845d25485f2141a96f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.888","next":"us-ky/krs-311.900"},"notice":"GroundRules: Original legal text.
