{"data":{"id":"us-ky/krs-311.909","jurisdiction":"us-ky","citation":"KRS 311.909","heading":"Disciplinary measures by the board -- Grounds  -- Procedures.","body":"(1) The  board may revoke, suspend, deny, decline to renew, limit, or restrict the\nlicense of an athletic trainer or may impose fines of not less than one hundred\ndollars ($100) and not more than five thousand dollars ($5,000) per violation,\nincluding the costs of any proceedings; reprimand; or place an athletic trainer\non probation for no more than five (5) years upon proof that the athletic trainer:\n(a) Knowingly made  or presented, or caused to be made  or presented, any\nfalse, fraudulent, or forged statement, writing, certificate, diploma, or other\ndocument relating to an application for licensure or renewal thereof;\n(b) Practiced or aided or abetted in the practice of fraud, forgery, deception,\ncollusion, or conspiracy relating to an examination for licensure;\n(c) Has  been convicted of a crime as defined in KRS  335B.010, if in\naccordance with KRS Chapter 335B;\n(d) Has  become  addicted to or is an abuser of alcohol, drugs, or any illegal\nsubstances;\n(e) Developed a physical or mental disability or other condition that presents\na danger in continuing to provide athletic training services to patients, the\npublic, or other health-care personnel;\n(f) Knowingly made, caused to be made, or aided or abetted in the making\nof a false statement in any document executed in connection with the\npractice of athletic training;\n(g) Performed  any act or service as an athletic trainer without proper\nsupervision by a licensed physician;\n(h) Exceeded  the scope of medical services or procedures described by the\nsupervising physician in the application required under KRS 311.903;\n(i) Aided, assisted, or abetted another in the unlawful practice of medicine,\nosteopathy, chiropractics, or any healing art, including the unlawful\npractice of athletic training;\n(j) Willfully violated a confidential communication;\n(k) Performed  the services of an athletic trainer in an unprofessional,\nincompetent, or grossly or chronically negligent manner;\n(l) Has  been removed, suspended, expelled, or placed on probation by any\nhealth-care facility for unprofessional conduct, incompetence, negligence,\nor violation of any provision of KRS 311.900 to 311.928;\n(m) Violated any applicable provision of an administrative regulation relating\nto athletic training practice;\n(n) Violated any term of probation or other disciplinary order issued by the\nboard or an agreed order defined in KRS 311.550;\n(o) Failed to complete the required number of hours of approved continuing\neducation; or\n(p) Willfully violated any provision of KRS  311.900 to 311.928 or acted\noutside of the licensed athletic trainer's scope of practice.\n(2) All disciplinary proceedings against an athletic trainer shall be conducted in\naccordance  with the provisions of KRS  311.591, 311.592, 311.593, and\n311.599; KRS  Chapter 13B; and  any  related administrative regulations\npromulgated under KRS  Chapter 311, except that the provisions which apply to\nphysicians shall apply to athletic trainers.\n(3) Notwithstanding any of the requirements for licensure established by KRS\n311.900 to 311.928, the board, after providing the applicant with reasonable\nnotice of its intended action and a reasonable opportunity to be heard, may\ndeny licensure to an applicant without a prior evidentiary hearing upon a finding\nthat the applicant has violated any provisions of KRS  311.900 to 311.928 or is\notherwise unfit to practice. Orders denying licensure may  be  appealed\npursuant to KRS 311.593.\n(4) The  board may  impose restrictions on the scope of practice of an athletic\ntrainer after providing the applicant with reasonable notice of its intended action\nand  a reasonable opportunity to be heard. The Athletic Trainers Advisory\nCouncil may make recommendations on such restrictions.\n(5) The  provisions of this chapter shall not be construed as preventing or\nrestricting the practices, services, or activities of a  person licensed in\naccordance with the provisions of another law of the Commonwealth  from\nengaging in the profession or occupation for which he or she is licensed.","path":["KRS Chapter 311"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46809","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:07Z","sha256":"f20bd791b9e43fc076f8c64cae91a2679c0e00cbe39d2b427528c0897659c04f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311.908","next":"us-ky/krs-311.910"},"notice":"GroundRules: Original legal text.
