{"data":{"id":"us-ky/krs-311a.020","jurisdiction":"us-ky","citation":"KRS 311A.020","heading":"Powers and duties of board -- Executive director and deputy executive","body":"director -- Persons employed by board -- Personnel committee -- Proposed\nbiennial budget.\n(1) The board shall:\n(a) Exercise all of the administrative functions of the state not regulated by the\nBoard of Medical Licensure or Cabinet for Health and Family Services in the\nregulation of the emergency medical services system and the practice of\nemergency medical services, and emergency medical services training and\neducation institutes, with the exception of employment of personnel as\ndescribed in subsections (5) and (6) of this section;\n(b) Issue any licenses or certifications authorized by this chapter;\n(c) Oversee the operations and establish the organizational structure o f the Office\nof the Kentucky Board of Emergency Medical Services, which is created and\nshall be attached to the board for administrative purposes. The office shall be\nheaded by the executive director appointed under paragraph (d) of this\nsubsection and shall be responsible for:\n1. Personnel and budget matters affecting the board;\n2. Fiscal activities of the board, including grant writing and disbursement\nof funds;\n3. Information technology, including the design and maintenance of\ndatabases;\n4. Certification and recertification of emergency medical responders;\n5. Certification and recertification of emergency medical technicians and\nadvanced emergency medical technicians;\n6. Licensure and relicensure of ambulances, ambulance services, and\nmobile integrated healthcare programs;\n7. Licensure and relicensure of paramedics;\n8. Certification and recertification of advanced practice paramedics;\n9. Certification and recertification of EMS educators and emergency\nmedical services training programs;\n10. Licensure and relicensure of emergency medical services training and\neducation institutes;\n11. Investigation of and resolution of complaints and ethics issues\npertaining to professional certifications and licenses;\n12. The resolution of complaints and ethics issues pertaining to ambulances,\nambulance services, and mobile integrated healthcare programs; and\n13. Other responsibilities that may be assigned to the executive director by\nthe board;\n(d) Employ an executive director and deputy executive director and fix the\ncompensation. The executive director and deputy executive dire ctor shall\nserve at the pleasure of the board, administer the day -to-day operations of the\nOffice of the Kentucky Board of Emergency Medical Services, and supervise\nall directives of the board. The director and deputy executive director shall\npossess a bac calaureate degree and shall have no less than five (5) years of\nexperience in public administration or in the administration of an emergency\nmedical services program;\n(e) Employ or contract with a physician licensed in Kentucky who is board\ncertified in em ergency medicine and fix the compensation. The physician\nshall serve at the pleasure of the board and as the medical advisor to the\nKentucky Board of Emergency Medical Services and the staff of the board;\n(f) Employ or contract with an attorney licensed to  practice law in Kentucky and\nfix the compensation. The attorney shall serve at the pleasure of the board and\nhave primary assignment to the board. The board and the attorney shall\nimplement and oversee the regulatory process;\n(g) Employ personnel sufficie nt to carry out the statutory responsibilities of the\nboard in accordance with the following:\n1. Personnel assigned to investigate an emergency medical responder\nprogram complaint or regulate the emergency medical responder\nprograms shall be certified emer gency medical responders, emergency\nmedical technicians, advanced emergency medical technicians, or\nlicensed paramedics;\n2. Personnel assigned to investigate an emergency medical technician\nprogram complaint or regulate the emergency medical technician\nprogram shall be certified emergency medical technicians, advanced\nemergency medical technicians, or paramedics;\n3. Personnel assigned to investigate an advanced emergency medical\ntechnician program complaint or regulate the advanced emergency\nmedical technic ian program shall be certified advanced emergency\nmedical technicians or paramedics;\n4. Personnel assigned to investigate a paramedic program complaint or\nregulate the paramedic program shall be licensed paramedics;\n5. A person who is employed by the board  who is licensed or certified by\nthe board shall retain his or her license or certification if he or she meets\nthe in -service training requirements and pays the fees specified by\nadministrative regulation;\n6. A person who is employed by the board may instr uct in emergency\nmedical subjects in which he or she is qualified, with the permission of\nthe board. All instruction shall be rendered without remuneration other\nthan his or her state salary and the employee shall be considered as on\nstate duty when teaching; and\n7. A person who is employed by the board may render services for which\nthe person is qualified at a declared disaster or emergency or in a\nsituation where trained personnel are not available until those personnel\narrive to take over the patient, or  where insufficient trained personnel\nare available to handle a specific emergency medical incident. All aid\nshall be rendered without remuneration other than the employee's state\nsalary and the employee shall be considered as on state duty when\nrendering aid. In cases specified in this paragraph, the state medical\nadvisor shall serve as the emergency medical services medical director\nfor the employee;\n(h) Establish committees and subcommittees and the membership thereof.\nMembers of committees and subcommittees do not need to be members of the\nboard but shall reflect the qualifications of the board members;\n(i) Enter into contracts, apply for grants and federal funds, and disburse funds to\nlocal units of government as approved by the General Assembly. All fu nds\nreceived by the board shall be placed in a trust and agency account in the\nState Treasury subject to expenditure by the board;\n(j) Administer the Emergency Medical Services for Children Program; and\n(k) Establish minimum curriculum and standards for em ergency medical services\ntraining.\n(2) The board may utilize materials, services, or facilities as may be made available to\nit by other state agencies or may contract for materials, services, or facilities.\n(3) The board may delegate to the executive direc tor, by written order, any function\nspecified in this chapter other than promulgation of an administrative regulation.\n(4) Except for securing funding for trauma centers, the board shall not serve as the lead\nagency relating to the development or regulatio n of trauma systems, but shall be a\npartner with other state agencies in the development, implementation, and oversight\nof such systems.\n(5) The chair of the board shall appoint a personnel committee. The personnel\ncommittee shall conduct an annual job performance review of the executive\ndirector, the medical advisor, and the board attorney that conforms with the state\npersonnel standards and i ncludes a recommendation for or against continued\nemployment to be presented to the board.\n(6) The board shall develop a proposed biennial budget for all administrative and\noperational functions and duties.","path":["KRS Chapter 311A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57600","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:07Z","sha256":"f25b333c749b64aa8935af7b21cbb0e16960c37a64b493d039ae19db5ab69d50","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311a.015","next":"us-ky/krs-311a.022"},"notice":"GroundRules: Original legal text.
