{"data":{"id":"us-ky/krs-311a.022","jurisdiction":"us-ky","citation":"KRS 311A.022","heading":"Transfer of employees of the Kentucky Board of Emergency Medical","body":"Services under the Community and Technical College System to KRS Chapter\n18A personnel system.\n(1) Except for personnel under subsection (2) of this section, personnel employed  by\nthe Kentucky Board of Emergency Medical Services under the Kentucky\nCommunity and Technical College System shall be transferred to the Kentucky\nBoard of Emergency Medical Services in the KRS Chapter 18A personnel system\nalong with the funding associated with those employees.\n(2) (a) Personnel employed by the Kentucky Board of Emergency Medical Services\nunder the Kentucky Community and Technical College System who\nparticipate in a defined contribution plan that meets the requirements of 26\nU.S.C. sec. 40 3(b) for employees of the Kentucky Community and Technical\nCollege System may choose to remain in their present employment and be\nassigned to the board to continue providing these services or become an\nemployee of the board under the KRS Chapter 18A personnel system.\n(b) An employee shall make his or her choice under paragraph (a) of this\nsubsection within thirty (30) days following July 14, 2022, and shall have\naccess to counseling by representatives of the KRS Chapter 18A personnel\nsystem, the Kentucky Co mmunity and Technical College System, and\napplicable retirement systems concerning the effect the choice of employment\nwould have on the employee. If an employee does not make a choice within\nthirty (30) days following July 14, 2022, that employee shall be  deemed to\nhave chosen to exercise the option to become an employee of the board under\nthe KRS Chapter 18A personnel system.\n(3) Employees transferred pursuant to subsections (1) and (2) of this section shall\nretain:\n(a) Their salaries and leave time balances accumulated as of the transfer date;\n(b) For purposes of determining leave time accumulation, the date of initial\nemployment with a state agency or a postsecondary educational institution,\nwhichever is earlier; and\n(c) For purposes of calculating retir ement and retiree health benefits and\ncontributions, the earlier of the date of initial participation or membership\ndate, in:\n1. A state-administered retirement system if the employee has participated\nor is participating in the Kentucky Employees Retirement System; or\n2. A defined contribution plan that meets requirements of 26 U.S.C. sec.\n403(b) for employees of the Kentucky Community and Technical\nCollege System.\nNothing in this paragraph shall be construed to provide additional service\ncredit for the em ployee prior to the transfer date other than what has been\ncredited to the appropriate retirement system.\n(4) All existing state general fund moneys appropriated to the board, all federal funds,\nall moneys collected by the board, all equipment owned by the  board, and\ninstructional supplies, equipment, funds, and records of the Kentucky Community\nand Technical College System associated with the Kentucky Board of Emergency\nMedical Services shall be transferred to the Kentucky Board of Emergency Medical\nServices in the KRS Chapter 18A personnel system along with all financial and\nmanagement oversight responsibility and liability.","path":["KRS Chapter 311A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52876","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:07Z","sha256":"d3cc144de65c4897771f4866d384385e25d3f3c2a272af205d9d06b71b14933e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311a.020","next":"us-ky/krs-311a.024"},"notice":"GroundRules: Original legal text.
