{"data":{"id":"us-ky/krs-311a.040","jurisdiction":"us-ky","citation":"KRS 311A.040","heading":"Advisory opinions.","body":"(1) The board may, on petition by an interested party, issue an advisory opinion relating\nto the applicability to any person, property, or state of facts of a statute in this\nchapter, administrative regulation promulgated by the board, decision, order, or\nother written statement of law or policy within the jurisdiction of the board.\n(2) An advisory opinion shall be binding on the board and all parties to the proceeding\non the statement of facts alleged.\n(3) The board may not retroactively change an advisory opi nion, but nothing in this\nsection shall prevent the board from prospectively changing an advisory opinion.\n(4) The board shall promulgate an administrative regulation in accordance with KRS\nChapter 13A on procedures for submission, consideration, reconside ration, and\ndisposition of a petition for an advisory opinion.\n(5) An advisory opinion of the board may be appealed to the Franklin Circuit Court\nwithin thirty (30) days of the date of the advisory opinion by the board.\n(6) Each advisory opinion shall be a public record and shall be published in the manner\nspecified by the board.\n(7) When the board supersedes, vacates, modifies, or repeals a previous advisory\nopinion the new opinion shall specify each previous opinion affected.","path":["KRS Chapter 311A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48854","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:07Z","sha256":"adb5acde898bedb27d9827034ebd98f60c9642fbc6c5fbe363875d7f20c01f6f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311a.035","next":"us-ky/krs-311a.045"},"notice":"GroundRules: Original legal text.
