{"data":{"id":"us-ky/krs-311a.050","jurisdiction":"us-ky","citation":"KRS 311A.050","heading":"Restrictions on persons and programs not licensed or certified --","body":"Activities prohibited to persons licensed or certified -- Reporting of prohibited\nactivities -- Penalties and disciplinary action.\n(1) A person shall not:\n(a) Call or hold h imself or herself out as or use the title of emergency medical\ntechnician, advanced emergency medical technician, emergency medical\nresponder, paramedic, advanced practice paramedic, emergency medical\nservices educator, paramedic course coordinator, emerge ncy medical services\nmedical director, mobile integrated healthcare program medical director, or\nany other member of emergency medical services personnel unless licensed or\ncertified under the provisions of this chapter. The provisions of this paragraph\nshall not apply if the board does not license or certify a person as an instructor\nin a particular discipline regulated by the board;\n(b) Operate or offer to operate or represent or advertise the operation of a school\nor other educational program for emergen cy medical services personnel\nunless the school or educational program has been approved and licensed\nunder the provisions of this chapter. The provisions of this paragraph shall not\napply to continuing education provided by a licensed ambulance service fo r\nanyone certified or licensed by the board given by an ambulance service for\nits employees or volunteers; or\n(c) Knowingly employ emergency medical services personnel unless that person\nis licensed or certified under the provisions of this chapter.\n(2) A person who is licensed or certified by the board or an applicant for licensure or\ncertification by the board shall not:\n(a) If licensed or certified, violate any provision of this chapter or any\nadministrative regulation promulgated by the board;\n(b) Use f raud or deceit in obtaining or attempting to obtain a license or\ncertification from the board, or be granted a license upon mistake of a material\nfact;\n(c) If licensed or certified by the board, grossly negligently or willfully act in a\nmanner inconsistent with the practice of the discipline for which the person is\ncertified or licensed;\n(d) Be unfit or incompetent to practice a discipline regulated by the board by\nreason of negligence or other causes;\n(e) Abuse, misuse, or misappropriate any drugs placed i n the custody of the\nlicensee or certified person for administration, or for use of others;\n(f) Falsify or fail to make essential entries on essential records;\n(g) Be convicted of a misdemeanor which involved acts that bear directly on the\nqualifications or ability of the applicant, licensee, or certified person to\npractice the discipline for which the person is an applicant, licensee, or\ncertified person, if in accordance with KRS Chapter 335B;\n(h) Be convicted of a misdemeanor which involved fraud, deceit, breach of trust,\nor physical harm or endangerment to self or others, acts that bear directly on\nthe qualifications or ability of the applicant, licensee, or certi ficate holder to\npractice acts in the license or certification held or sought, if in accordance\nwith KRS Chapter 335B;\n(i) Be convicted of a misdemeanor offense under KRS Chapter 510 involving a\npatient or be found by the board to have had sexual contact a s defined in KRS\n510.010 with a patient while the patient was under the care of the licensee or\ncertificate holder;\n(j) Have had his or her license or credential to practice as a nurse or physician\ndenied, limited, suspended, probated, revoked, or otherwis e disciplined in\nKentucky or in another jurisdiction on grounds sufficient to cause a license to\nbe denied, limited, suspended, probated, revoked, or otherwise disciplined in\nthis Commonwealth;\n(k) Have a license or certification to practice in any activit y regulated by the\nboard denied, limited, suspended, probated, revoked, or otherwise disciplined\nin another jurisdiction on grounds sufficient to cause a license or certification\nto be denied, limited, suspended, probated, revoked, or otherwise disciplined\nin this Commonwealth;\n(l) Violate any lawful order or directive previously entered by the board;\n(m) Have been listed on the nurse aide abuse registry with a substantiated finding\nof abuse, neglect, or misappropriation of property; or\n(n) Be convicted of, have entered a guilty plea to, or have entered an Alford plea\nto a felony offense, if in accordance with KRS Chapter 335B.\n(3) It shall be unlawful for an employer of a person licensed or certified by the board\nhaving knowledge of the facts to refrain fro m reporting to the board on an official\ncomplaint form approved by the board through administrative regulation any person\nlicensed or certified by the board who:\n(a) Has been convicted of, has entered a guilty plea to, or has entered an Alford\nplea to a felony offense;\n(b) Has been convicted of a misdemeanor or felony which involved acts that bear\ndirectly on the qualifications or ability of the applicant, licensee, or certified\nperson to practice the discipline for which they are an applicant, licensee, or\ncertified person;\n(c) Is reasonably suspected of fraud or deceit in procuring or attempting to\nprocure a license or certification from the board;\n(d) Is reasonably suspected of grossly negligently or willfully acting in a manner\ninconsistent with the prac tice of the discipline for which they are certified or\nlicensed;\n(e) Is reasonably suspected of being unfit or incompetent to practice a discipline\nregulated by the board by reason of negligence or other causes, including but\nnot limited to being unable to  practice the discipline for which they are\nlicensed or certified with reasonable skill or safety;\n(f) Is reasonably suspected of violating any provisions of this chapter or the\nadministrative regulations promulgated under this chapter;\n(g) Has a license o r certification to practice an activity regulated by the board\ndenied, limited, suspended, probated, revoked, or otherwise disciplined in\nanother jurisdiction on grounds sufficient to cause a license or certification to\nbe denied, limited, suspended, proba ted, revoked, or otherwise disciplined in\nthis Commonwealth;\n(h) Is practicing an activity regulated by the board without a current active license\nor certification issued by the board;\n(i) Is reasonably suspected of abusing, misusing, or misappropriating a ny drugs\nplaced in the custody of the licensee or certified person for administration or\nfor use of others; or\n(j) Is suspected of falsifying or in a grossly negligent manner making incorrect\nentries or failing to make essential entries on essential records.\n(4) A person who violates subsection (1)(a), (b), or (c) of this section shall be guilty of\na Class A misdemeanor for the first offense and a Class D felony for each\nsubsequent offense.\n(5) This section shall not preclude prosecution for the unlawful pr actice of medicine,\nnursing, or other practice certified or licensed by an agency of the Commonwealth.\n(6) The filing of criminal charges or a criminal conviction for violation of the\nprovisions of this chapter or the administrative regulations promulgated  under this\nchapter shall not preclude the office of the board from instituting or imposing board\ndisciplinary action authorized by this chapter against any person or organization\nviolating this chapter or the administrative regulations promulgated under t his\nchapter.\n(7) The institution or imposition of disciplinary action by the office of the board against\nany person or organization violating the provisions of this chapter or the\nadministrative regulations promulgated under this chapter shall not preclude  the\nfiling of criminal charges against or a criminal conviction of any person or\norganization for violation of the provisions of this chapter or the administrative\nregulations promulgated under this chapter.","path":["KRS Chapter 311A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57427","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:07Z","sha256":"41c10a395044c5db125a5f3f5edfff3665dfd42c91ec66d400e7b51fa2f0fdc1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311a.045","next":"us-ky/krs-311a.055"},"notice":"GroundRules: Original legal text.
