{"data":{"id":"us-ky/krs-311a.060","jurisdiction":"us-ky","citation":"KRS 311A.060","heading":"Sanctions for violations -- Disciplinary actions -- Criminal charges.","body":"(1) (a) If it is determined that an entity or a member of emergency medical services\npersonnel regulated, licensed, or certified by the board has violated a statute,\nadministrative regulation, protocol, or practice standard relating to serving as\nan entity or a member of emergency medical services personnel regulated by\nthe board, the office of the board may impose any of the sanctions provided in\nsubsection (2) of this section. Any party to the complaint shall have the right\nto propose findings of fact and  conclusions of law, and to recommend\nsanctions.\n(b) For the purposes of this subsection, violation of \" a statute, administrative\nregulation, protocol, or practice standard relating to serving as an entity\nregulated by the board, a paramedic, first respon der, or emergency medical\ntechnician\" shall include violation of KRS 304.39 -215 and conduct that is\nsubject to the penalties under KRS 304.99-060(4) or (5).\n(2) The office of the board shall require an acceptable plan of correction and may use\nany one (1) or more of the following sanctions when disciplining emergency\nmedical services personnel or any entity regulated by the board:\n(a) Private reprimand that shall be shared with each of the paramedic's,\nemergency medical responder's, advanced emergency medic al technician's, or\nemergency medical technician's emergency medical services or related\nemployer and medical director;\n(b) Public reprimand;\n(c) Fines of fifty dollars ($50) to five hundred dollars ($500) for a natural person\nor fifty dollars ($50) to fiv e thousand dollars ($5,000) for a public agency or\nbusiness entity;\n(d) Revocation of certification or licensure;\n(e) Suspension of certification or licensure until a time certain;\n(f) Suspension until a certain act or acts are performed;\n(g) Limitation of practice permanently;\n(h) Limitation of practice until a time certain;\n(i) Limitation of practice until a certain act or acts are performed;\n(j) Repassing a portion of the paramedic, emergency medical responder,\nadvanced emergency medical technician, or emergency medical technician\nexamination;\n(k) Probation for a specified time; or\n(l) If it is found that the person who is licensed or certified by  the board has been\nconvicted of, pled guilty to, or entered an Alford plea to a felony offense, the\nlicense or certification shall be revoked.\n(3) The filing of criminal charges or a criminal conviction for violation of the\nprovisions of this chapter or t he administrative regulations promulgated thereunder\nshall not preclude the office of the board from instituting or imposing board\ndisciplinary action authorized by this chapter against any person or organization\nviolating this chapter or the administrative regulations promulgated thereunder.\n(4) The institution or imposition of disciplinary action by the office of the board against\nany person or organization violating the provisions of this chapter or the\nadministrative regulations promulgated thereunder s hall not preclude the filing of\ncriminal charges against or a criminal conviction of any person or organization for\nviolation of the provisions of this chapter or the administrative regulations\npromulgated thereunder.","path":["KRS Chapter 311A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48857","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:07Z","sha256":"ac718ca8cf491b0dccdc3cd0e0aada87012a100a15d33560d64dff8794495541","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311a.055","next":"us-ky/krs-311a.065"},"notice":"GroundRules: Original legal text.
