{"data":{"id":"us-ky/krs-311a.065","jurisdiction":"us-ky","citation":"KRS 311A.065","heading":"Psychological or physical evaluation.","body":"(1) If the office of the board has reasonable cause to believe that any licensee or\ncertificate holder or any applicant for licensure or certification by examination,\nreinstatement, or change of status is unable to practice with reasonable skill or\nsafety or h as abused alcohol or drugs, it may require the person to submit to a\nmental health, neuropsychological, psychosocial, psychosexual, substance use\ndisorder, or physical evaluation by a licensed or certified practitioner designated by\nthe board. Upon the fai lure of the person to submit to a mental health,\nneuropsychological, psychosocial, psychosexual, substance use disorder, or physical\nevaluation, unless due to circumstances beyond the person's control, the office of\nthe board may initiate an action for imm ediate temporary suspension pursuant to\nthis chapter or deny the application until the person submits to the required\nevaluation. The office of the board may issue an immediate and temporary\nsuspension from the time of the evaluation until the hearing.\n(2) Every licensee or certificate holder or applicant for licensure or certification by\nexamination, reinstatement, or change of status shall be deemed to have given\nconsent to submit to a mental health, neuropsychological, psychosocial,\npsychosexual, substan ce use disorder, or physical evaluation when so directed in\nwriting by the board. The direction to submit to an evaluation shall contain the basis\nof the office of the board's reasonable cause to believe that the person is unable to\npractice with reasonable skill or safety, or has abused alcohol or drugs. The person\nshall be deemed to have waived all objections to the admissibility of the examining\nphysician's or psychologist's testimony or evaluation reports on the ground of\nprivileged communication.\n(3) The licensee or certificate holder or applicant for licensure or certification by\nexamination, reinstatement, or change of status shall bear the cost of any mental\nhealth, neuropsychological, psychosocial, psychosexual, substance use disorder, or\nphysical evaluation ordered by the board.","path":["KRS Chapter 311A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48858","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:08Z","sha256":"fc65019b895b2ba2a5d3670933fc204f8f40bdc227bd8a8be719a89a7fa89b9d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311a.060","next":"us-ky/krs-311a.070"},"notice":"GroundRules: Original legal text.
