{"data":{"id":"us-ky/krs-311a.075","jurisdiction":"us-ky","citation":"KRS 311A.075","heading":"Immediate temporary suspension of license or certification -- Hearing.","body":"(1) The chair of the board, or his or her designee, in writing, may determine that\nimmediate temporary suspension of a license or certification of a natural person\nagainst whom disciplinary action or an investigation is pending is necessary in order\nto pro tect the public. If the defendant is employed by an emergency medical\nservices provider, the input of the employer's emergency medical services medical\ndirector or mobile integrated healthcare program medical director may be sought\nwith regard to the matte r. In the event of an action against an organization, the\ndetermination that an immediate temporary suspension is necessary in order to\nprotect the public shall be made by the chair of the board, or his or her designee, in\nwriting. When this action may be necessary, the executive director, in writing, shall\nissue an emergency order suspending the licensee or certificate holder. Upon appeal\nof an emergency order, an emergency hearing shall be conducted in accordance with\nKRS 13B.125.\n(2) No board member shal l be disqualified from serving on a disciplinary action\nhearing panel for the reason that he or she has previously sat on a preliminary\ninquiry panel hearing of the same licensee or certification holder.\n(3) Disciplinary actions in which a license or certi fication has been temporarily\nsuspended and a hearing shall be held in accordance with KRS 13B.125 within\nninety (90) days unless the defendant requests an extension of time.\n(4) The order of immediate temporary suspension shall remain in effect until eith er\nretracted or superseded by final disciplinary action by the office of the board.
