{"data":{"id":"us-ky/krs-311a.170","jurisdiction":"us-ky","citation":"KRS 311A.170","heading":"Paramedics -- Administrative regulations -- Permitted activities --","body":"Employment by hospitals -- Reasonable control by employers.\n(1) Subject to the provisions of this section, a paramedic may perform any procedure:\n(a) Specified in the most rec ent curriculum of the United States Department of\nTransportation training course for paramedics; and\n(b) Any additional procedure specified by the board by administrative regulation.\n(2) When there is a change in the United States Department of Transportat ion\ncurriculum for paramedics, or the board approves an additional skill or procedure\nby administrative regulation, or approves a protocol differing from the curriculum\nor administrative regulations, no person who was not trained under that curriculum\nor a dministrative regulation shall perform any activity or procedure in the new\ncurriculum, administrative regulation, or protocol unless the person has been trained\naccording to the new curriculum, administrative regulation, or protocol and\ndemonstrates competency in the new knowledge or skill. Competency in a new skill\nshall be demonstrated through a return demonstration to a competent evaluator. If\nthe board adopts the new procedure or skill, the board shall promulgate an\nadministrative regulation specifying  the new procedure, training requirements,\nexamination requirements, and a time period during which the paramedic shall\nsuccessfully complete the material or lose his or her license as a paramedic.\n(3) The board shall promulgate administrative regulations in accordance with KRS\nChapter 13A establishing the educational requirements, testing requirements,\ncredentialing, and licensure requirements of advanced practice paramedics.\nAdvanced practice paramedics shall validate competency as prescribed in\nadministrative regulations and be identified as one (1) or more of the following\ncertification levels of advanced practice paramedic:\n(a) Certified community paramedic;\n(b) Certified critical care paramedic;\n(c) Certified flight paramedic;\n(d) Certified tactical paramedic; or\n(e) Certified wilderness paramedic.\n(4) A paramedic may draw blood samples from a criminal defendant upon the request\nof a peace officer and the consent of the defendant, or without the consent of the\ndefendant upon receipt of a court order requiring the procedure, if the paramedic is\nauthorized to do so by his or her employer. The authorization shall be in writing and\nmay be by general written policy of the employer and the service's medical director.\nThe paramedic who drew the blood sample shall deliver the sample to the peace\nofficer or other person specified by the court in a court order and shall testify in\ncourt with regard thereto upon service of a proper subpoena.\n(5) A paramedic shall be permitted to render services only under the supervision of a\ncertified emergency medical services medi cal director, certified mobile integrated\nhealthcare program medical director, or under the direct supervision of an\nemergency department medical director.\n(6) A paramedic holding board certification as a community paramedic may provide\nmobile integrated h ealthcare services only as an employee of a mobile integrated\nhealthcare program licensed and authorized in accordance with administrative\nregulations promulgated by the Kentucky Board of Emergency Medical Services.\n(7) Any provision of this chapter other than this section relating to the requirement for\nadditional training, requirement for skill examination, or approval of standing\norders, protocols, or medical procedures to the contrary notwithstanding, a\nparamedic may be employed by a hospital to work as  a licensed paramedic in the\nemergency department of the hospital subject to the following conditions:\n(a) The hospital in collaboration with the medical staff shall provide operating\nprocedures and policies under which the paramedic shall operate consiste nt\nwith the paramedic's scope of practice;\n(b) A paramedic shall provide patient care services under the orders of a\nphysician, physician assistant, advanced practice registered nurse, or as\ndelegated by a registered nurse;\n(c) Subject to the provisions re lating to the scope of practice of a paramedic, a\nhospital may require a paramedic to take additional training on any subject or\nskill which the paramedic may be required to perform in a hospital and\ndemonstrate competency in the skill or subject to a competent evaluator; and\n(d) The paramedic does not violate the provisions of KRS 311A.175 or any other\nstatute or administrative regulation relating to a paramedic.\nNo provision of this section shall prevent a paramedic from being employed in any\nother secti on of the hospital where the paramedic's job duties do not require\ncertification or licensure by the board and do not otherwise constitute the unlawful\npractice of medicine.\n(8) Except as provided in subsection (2) of this section, nothing in this section shall\nprevent an employer from exercising reasonable fiscal control over the costs of\nproviding medical services to its citizens nor prevent the employer from exercising\nany reasonable control over paramedics providing care on behalf of the licensed\nentity.","path":["KRS Chapter 311A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54516","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:08Z","sha256":"e95e9d0237736df25eef597dafd7755a2424aac6bfa7331e22ceca253c632dc6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311a.167","next":"us-ky/krs-311a.172"},"notice":"GroundRules: Original legal text.
