{"data":{"id":"us-ky/krs-311a.175","jurisdiction":"us-ky","citation":"KRS 311A.175","heading":"Exceeding scope of practice -- Discipline prohibited for refusal to exceed","body":"scope of practice.\n(1) No certified emergency medical responder shall perform any act or procedure which\nexceeds the scope of practice of an emergency medical responder  as specified in\nthis chapter and in administrative regulations promulgated by the board.\n(2) No emergency medical technician shall perform any act or procedure which exceeds\nthe scope of practice of an emergency medical technician as specified in this chapter\nand in administrative regulations promulgated by the board.\n(3) No advanced emergency medical technician shall perform any act or procedure\nwhich exceeds the scope of practice of an advanced emergency medical technician\nas specified in this chapter an d in administrative regulations promulgated by the\nboard.\n(4) No paramedic shall perform any act or procedure which exceeds the scope of\npractice of a paramedic as specified in this chapter, administrative regulations\npromulgated by the board, protocol, st anding order, or other document approved by\nthe board.\n(5) A certified emergency responder, emergency medical technician, advanced\nemergency medical technician, or licensed paramedic is presumed to know the\nstandards of practice for his or her level of certification or licensure.\n(6) It is the legal duty of an emergency medical responder, emergency medical\ntechnician, advanced emergency medical technician, or paramedic to refuse to\nperform any act or procedure which is beyond the scope of practice for his o r her\nlevel of certification or licensure regardless of whether that act or procedure is\nordered by a physician, physician assistant, medical director, advanced practice\nregistered nurse, registered nurse, or supervisor.\n(7) No employer or organization for  which an emergency medical responder,\nemergency medical technician, advanced emergency medical technician, or\nparamedic has volunteered shall reprimand, discipline, or dismiss an emergency\nmedical responder, emergency medical technician, advanced emergenc y medical\ntechnician, or paramedic who has refused to perform an act or procedure which the\nemergency medical responder, emergency medical technician, advanced emergency\nmedical technician, or paramedic knows is in violation of the provisions of this\nsection. Violation of this section by an employer or by an organization for which an\nemergency medical responder, emergency medical technician, advanced emergency\nmedical technician, or paramedic has volunteered shall be grounds for a legal action\nfor wrongful discipline or wrongful discharge, as appropriate.\n(8) The provisions of this section shall not apply to an order to perform an act or\nprocedure:\n(a) For which a license or certification by the board is not required and which\notherwise do not constitute the unlawful practice of medicine; or\n(b) For which no license or certification is required and does not involve medical\ncare or treatment; or\n(c) For which a license or certification issued by an agency other than the board is\nrequired and the emergency medi cal responder, emergency medical\ntechnician, advanced emergency medical technician, or paramedic holds such\na license or certification.","path":["KRS Chapter 311A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48866","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:08Z","sha256":"d8e3ca37eba1907356a63442c62fac568c922a7b545de5a5fad75d77177202c4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-311a.172","next":"us-ky/krs-311a.180"},"notice":"GroundRules: Original legal text.
