{"data":{"id":"us-ky/krs-312.019","jurisdiction":"us-ky","citation":"KRS 312.019","heading":"Powers of board.","body":"(1) The board shall administer the provisions of this chapter and the administrative\nregulations promulgated by the board relating to the practice of chiropractic.\n(2) The board shall pass upon the qualifications of applicants for a license, certification,\nor registration to practice chiropractic. It shall examine, license, certify, register, and\nrenew the license, certification, or registration of duly qualified applicants.\n(3) The board may deny, revoke, limit, impose probationary conditions, refuse to\nrenew, or suspend any license, certification, or registration issued by it.\n(4) The board shall adopt a seal which shall be affixed to all licenses, certifications, and\nregistrations issued by the board and to such other documents as the board deems\nnecessary.\n(5) The board shall regulate the practice of chiropractic by persons licensed or certified\nby it and shall enforce the provisions of this chapter and the administrative\nregulations of the board. The board may investigate violations and cause the\nprosecution of persons violating the provisions of this chapter or the administrative\nregulations promulgated by the board.\n(6) The board may employ such personnel and incur such expenses as may be necessary\nfor the performance of its duties and the enforcement of this chapter.\n(7) The board may prescribe and collect reasonable fees for the issuance and renewal of\nlicenses, certifications, and registrations and the administration of examinations as\nprovided in KRS 312.095 and 312.175.\n(8) The board may inspect at all reasonable times any chiropractic office or place where\nchiropractic services are performed and inspect chiropractic records, a copy of\nwhich may be obtained by the board, and question all persons.\n(9) The board may promulgate and from time to time amend administrative regulations,\nconsistent with the provisions of this chapter and in accordance with the provisions\nof KRS Chapter 13A, governing the practice of chiropractic and the diagnosis and\ntreatment of patients, the enforcement of this chapter and the proper performance of\nits duties, including but not limited to:\n(a) A code of ethical conduct governing the practice of chiropractic;\n(b) Requirements, standards, and examinations to determine the moral, physical,\nintellectual, educational, scientific, tec hnical, and professional qualifications\nof applicants for licenses and certifications;\n(c) Matters pertaining to the content and conduct of examinations;\n(d) Matters pertaining to the operation and registration of chiropractic clinics;\n(e) Matters pertaining to the practice and certification of chiropractic specialties\nby licensed doctors of chiropractic;\n(f) The type, character, and location of postgraduate study to be done by any\nlicensee in order to comply with the provisions of KRS 312.175;\n(g) Regulation of forms of advertising or solicitation that are false, misleading, or\ndeceptive or otherwise in violation of this chapter. The board may require a\nseventy-two (72) hour rescission period for consumers responding to certain\nforms of solicitation or advertising proposing or offering a series or course of\ntreatments. The board may require that advertisements or solicitations stating\ncoverage available from third -party payors include a conspicuous notice that\npersons may be required to submit to an independent evaluation which may\nresult in a determination that the all or part of the services are unreasonable or\nunnecessary;\n(h) Establishing a recommended course of pre -chiropractic education to be\ncompleted prior to entry into chiropractic college an d the establishment of a\npreceptorship program for students enrolled in accredited chiropractic colleges\nthat conform to KRS 312.085 to meet the standards of accreditation of the\nCouncil on Chiropractic Education.\n(i) Registration and regulation of chiropr actic management consultants operating\nin Kentucky. The board may impose annual registration fees not to exceed two\nhundred dollars ($200); and\n(j) Establishing minimum standards for recordkeeping in chiropractic offices, the\nissuance of itemized statement s, and requiring that any record or report\ninclude the name of the treating chiropractor.\n(10) The board shall develop specific guidelines to follow upon receipt of an allegation\nof sexual misconduct by a chiropractor licensed by the board. The guidelines shall\ninclude investigation, inquiry, and hearing procedures which ensure the process\ndoes not revictimize the alleged victim or cause harm if a chiropractor is falsely\naccused.\n(11) The board, the hearing officer, and investigators hired by the board shal l receive\ntraining on the dynamics of sexual misconduct of professionals, including the nature\nof this abuse of authority, the characteristics of the offender, the impact on the\nvictim, the possibility and the impact of false accusations, investigative pro cedure\nin sex offense cases, and effective intervention with victims and offenders.","path":["KRS Chapter 312"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30762","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:08Z","sha256":"523b230b7766075f707b4392cc605cb96d53c6b651dcaef4999d726c7e6b0774","source_id":"us-ky","stale":false,"prev":"us-ky/krs-312.018","next":"us-ky/krs-312.020"},"notice":"GroundRules: Original legal text.
